The most concerning part of this story is that at least 4,900 presumably legal adults of voting age believed this was a legitimate way we vote in elections.

Well it appears the guy posted a meme suggesting you can vote via text, which is untrue and could deprive (very stupid people) the right to vote

The problem is there is no standard for depriving people their right to vote by say, taking their ballot into custody with zero confirmation your chosen candidate was actually the one your vote was cast for.

I think the “reasonable person” test means that a person of at least average intelligence would have to be mislead by such a thing.

How many “average” people thought they could vote by text?

They're going to spend the next few years crushing any and all dissent.

They're going back over 4 years to jail someone for satire on the internet. They still won't let the 2016 election go because they have no other strategy other than OMB.

If they created a group and ran a campaign with expressed purpose of targeting certain voting groups to suppress their vote the JD might have something.

Seems like the Justice Dept better have some good evidence, which they might.
