While many courts have held that premeditation can be a very short time you still have to make a conscious choice. The speed that he came up and immediately flipped the guy in the water does not look like premeditation to me. Now if you could prove his state of mind prior then that's different, but also almost impossible. This first 2nd degree in FL almost perfectly, 1st degree is much more of a stretch, and I would say it would give you less than a 50% chance of conviction based in whole on the video. I know nothing else about the case.

Most states require the commission of certain felonies to be a prerequisite for 1st degree murder.

This was just plain murder, so, 2nd degree is the correct charge.

Pretty sure that was his shoe.

That’s definitely a heat of the moment kind of thing, so premeditated doesn’t seem to fit IMO. And weirdly it looks like they both trip and fall. But he definitely tosses an unconscious man into the water on purpose. So whatever charge fits that works for me.

Wonder if you could make an argument that because he so quickly threw his unconscious body into the water that it was premeditated. It was so quick it's like he had already thought about it. Granted, the counter is that he didn't know the guy would be knocked out.
