Florida Second-Degree Murder (Fla. Stat. § 782.04(2))

The State must prove:

The victim is dead.
The death was caused by the defendant’s criminal act.
The act was imminently dangerous to another and demonstrated a depraved mind without regard for human life.

Don’t think it’s premeditated but definitely murder.

Depends on the FL 1st degree murder statute. Not 1st degree in LA. None of the aggravating factors.
