I've explained my position on the DP before, but if the prosecution theory is that the baby died from shaken baby syndrome, I have doubt that that is true. I think the baby was abused and died, most likely. I think this guy probably murdered that baby. But it's a mess and I think we're continually in the spot where we're going "all practical inferences and most of the evidence supports the idea that the perp did it, but we don't know exactly how it happened and we don't have the evidence to determine those specific questions." In such situations, I don't support the DP.

And it was 20+ years ago and he's in jail for life either way. If he "snapped and shook the baby" leading to the baby's death, I think that's murder but I'm not sure it's a typical case we'd apply the DP for in America. I just rarely find a compelling reason to support the DP in these cases.

I do question whether the absence of "shaken baby" theory would have cleaned this case up - ie, the injuries are consistent with violent beating and he killed that baby by grabbing and punching her, etc. I'm not sure the evidence is there for that but it could change some things for people like me.

But my real point was to note that the stories today are all "this guy was convicted of shaking a baby and now the shaken baby theory is in doubt." Obviously there is a lot more to it than that.

Agreed. Well, it wasn't shaken baby syndrome, he beat the baby to death the old fashioned way. He punched it.

Either way.. kill him deader than dead. I don't care if he's been in prison 60 years.

Well if he's innocent, he'll be in heaven with his 2 year old on Thursday.

Sounds like a great outcome if a stay isn't granted.

Because it mostly only cites the Innocence Project and his defense attorneys. Like someone else posted, they left a whole heap of evidence that was collected at the emergency room where the baby died and doctor testimony out of the article. Not to mention his violent history towards women and other children.

I could have sworn i read that the baby died of pneumonia and the shaken baby thing wasn't absolutely certain. I've also read that recently shaken baby syndrome has been basically debunked like bite mark analysis and some other similar things.
I'm all for the death penalty, I assure you. I do think it should be reserved for the most obviously guilty people that committed first degree premeditated murder. Kind of like what a supreme court justice said about obscenity, "I'll know it when I see it." The ones that deserve the death penalty are obvious and I know them when I see them. The monster in Florida from 20 years or so ago that kidnapped the girl from the trailer, raped her for a couple days then buried her alive in a trash bag. That fricker absolutely deserves it. This guy I'm not positive. Also it's been shown that he's retarded somehow and that makes one wonder if he truly got a fair trial since he probably couldn't aid in his own defense.

The lead detective on the case disagrees with you.

Despite plenty evidence suggesting the child died from Pneumonia, the dude isn't even asking to be released from prison just not be executed.

If he isn't executed, I suspect he'll be released after a new trial or exoneration in the next 2 yrs. That's fricked up to even type out mucless think about in this country.

He's just got the autism and didn't express typical body language and emotions of remorse. That could have affected the jury in his trial b/c they had no idea he was autistic.

He deserves a new trial at a minimum.

You misunderstand.

Murder is killing of an innocent. Murdered unborn babies don't get their mother's day in court, because you excuse her sexual misadventure.

An adult human who has heinously killed other people (previously born) including a pregnant female who WANTED her baby, deserves death.

So, yes, I speak for the innocents, whether unborn or born. Both should be free from murder, whether from a woman, who made a mistake or a monster who murdered a family. This isn't difficult.
