Yeah so legally it's worse than that . Seized money has no rights, doesn't require counsel to be present, and is presumed guilty until proven innocent . It's up to YOU the property owner to prove you have legal possession and weren't doing anything illegal with it before the court gives it back to you.
I’m generally against the war on drugs but opioids are destroying people.
Again I don’t buy what the article is selling me.
For all I know this dude was selling pressed pills and killed people with them.
A dude gets laid off so he decides to travel around with cash in his car instead of oh idk, getting another fricking job? I know when I’m saving to buy a house I just put it in my car.
The DOJ oversees the asset forfeiture program and they have no problem going after you.
I think we all agree we have a problem with the federal government and how they operate.
Two things can be true. This guy is shady and the government is incompetent.

Work in financial services. I’ve personally seen DHS seize almost $300,000 from a guy because a disgruntled former employee made baseless claims. He had to file a lawsuit to get it back.
Full disclosure, he was structuring his deposits. But that’s not a crime.

So, the little slut was asking for it?

If you google CAF there's a shite ton of horror stories out there, ranging from 1) LEOs in Texas pulling people over and seizing jewelry and other expensive items/money under threat of arrest or CPS taking their kids away to 2)Philly cops seizing parents whole houses because of claims their kid was selling dime bags of weed to 3)My personal favorite the sisters of the poor (nuns) getting stopped and stripped of cash under the guise of drug trafficking...
There's tons of others out there too, but this is why the drug war is so profitable for LEO's.

He was never charged. He wasn’t even arrested. They stole his money and left him in the side of the road.

He was laid off during Covid. He was on his way to visit his daughters for a week, not just randomly driving with cash.
Drugs are a problem, but perhaps attention should be focused on our wide open borders, and the drug war that’s currently taking place between China and the cartels in our country, rather than harassing citizens who have broken no laws.

I stand by my original statement that some guys understand freedom.

Vets look out for one another.. in my opinion a cop who hasn’t served is a fricking pussy. Should be manditory
Yeah, I thought they'd cut him some kind of break given he was acting appropriately and had served.
Especially if his child was with him, but I'm not sure if they were.
Glad to see he got his money back. He should get additional money from them, especially for not acting sooner.

You didn't respond to my reasoning.
There is zero reasoning to civil assist forfeiture. It should be utterly and completely destroyed. The “reasoning” that the state can arrest or detain “property” without cause is a SEVERE 4th Amendment violation to the individual, completely innocent, citizen.
It’s not libertarian nonsense. It’s disgusting violations of civil rights.

These cops and DA should be tried for treason and executed after being convicted.

Given what we know about civil asset forfeiture it's obviously a legit question
No, it isn't.

So they made up a crime and hit the jackpot all random?
In the video they are saying this is consistent with drug traffickers. All I’ve read is the article and it doesn’t prove much of anything other than this guy travels around state to state with a bunch of cash just sitting in the trunk.
I’m not buying the story I love my kids but I decided to leave them in another state and go live with my parents in Texas.
I don't care what he was doing. They had nothing on him when they stole the money and they have nothing on him all this time later.

Serious question- if this was you pulled over on the side of the road and robbed of your valuables (without charge, because I know you're innocent of whatever claim there may be...), I am curious what your reaction would be.
