It just needs simple reforms based in logic, primarily a conviction then safeguards on the ability to seize it until after the post-conviction civil process is completed.
The larger question where there will be lots of debate is how much the government can restrict using that property in the interim. There is some fricked up case law from the federal system where the feds are permitted to seize/freeze money from Defendants, which prevented them from being able to hire defense counsel.

Civil asset forfeiture is evil and un-American, and the fact that it hasn’t been eliminated in roaring bipartisan fashion should tell you all you need to know about what the government, from federal to state to local, thinks of your rights.

Drug dealers love CAF, b/c they can relinquish the goods in exchange for all charges dropped.
Cops keep the money and cars, drug dealers walk.
Win/win.

Absolute tyranny. Civil forfeiture was one of the things that pushed me away from Republican Party to the libertarians 30 years ago. I’ve since come back but these are absurd laws that no one should support.

As someone who I could see be considered a bootlicker in certain threads let me offer you my broad perspective to see if it sheds light.
