I just don't see how its at all possible to determine whether a crime or assault occurred at this point. Its a he said she said, with the "she" initially saying that the "he" did nothing illegal.

I think that she said she was raped while surrounded by a group of men after a social media invitation for guys to come frick her --correct or not -- is why so much public opinion has been questioning why the DA didn't pursue it.

from what i've read, and could be wrong obviously, this allegation / comment was ommitted from the summary to the DA as well as the snap chat invitation to the rest of the fraternity.

Yeah, all the publicly available evidence out there points to this being too much of a mess to possibly get to a conviction under a criminal standard. The civil case may be a different story with the PR involved creating significant incentives for settlements.

I don't think I'm going out on a limb to say :
If I were a campus police and I had a college girl claiming gang rape then saying maybe not since she took a lot of drugs and things were fuzzy and then a text telling a group of guys to come frick her.
I'd give ALL that info to the regular police as fast as I possibly could and put it on their plate.

Perhaps we'll see the actual contents of the entire submission. The omitted comment about "100% rape" was the girl's opinion. Findings were going to be based on the facts she alleged, not on her opinion as to what the legal findings should be. Based on the factset she provided at the time, her opinion was irrelevant.
She has now altered her claim though, and says Male #1 & #4 forced her to have oral sex later in the night, when the three of them were doing another threesome in a different room by themselves. I'd speculate that to be an attorney encouraged claim to strengthen her civil case. But Tish James will use it as basis for pursuing criminal charges. Given the trial venue, and state resources involved, Ingalls (Male #1) and Lopes (Male #4) will be in a tough spot, regardless of the truth of her claim.
Just a sad situation all around. Meanwhile, she's on social media, living in NY with a new boyfriend, and seems to be doing a-okay.

I realize most here want the girl to be wrong so badly they can't stand it.
However, that text message inviting more guys to come frick her is the exact thing which seems sketchier than horny college kids getting fricked up and crossing into gray areas.

I guess he could have said the girl attested to facts which clearly did not constitute rape. She told us it was rape in her opinion. Based on the facts she brought, her opinion was wrong.
But that would not be politically expedient, to put it mildly.
