I guess he could have said the girl attested to facts which clearly did not constitute rape. She told us it was rape in her opinion. Based on the facts she brought, her opinion was wrong.
Of course, you nor I have any idea exactly what happened.
However, if what happened is:
1. slutty college girl and her 2 or 3 slutty friends do a lot of drugs and she agrees to fool around with them
2. she gets high to the point she hardly knows what's going on or remembers many details
3. friends invite more of their random friends to frick her and do drugs off her body
If it happened like that -- and I have no idea that it did -- that Part 3 is certainly the point where it would become rape if she never consented to the invitation to more random guys for frick her.
And that text message has nothing to do with her opinion or memory,
So, whether or not the DA had the text message was probably the most crucial piece of evidence (beyond his story, her story, whether she felt embarrassed one minute and didn't want to press charges and angry the next and did etc ect etc).
I have no idea if the DA had the text message or not. But I can see where it's probably the most important detail.

dropping out the discussion after this and will wait to see how it all unfolds.
To your questions:
Regarding the "100% confidence I was raped" testimony, cbs news:
"I never saw it, never heard it until tonight. He added: "I'm going to follow up on this because this is news to me. If that kind of thing was omitted from a statement, if it is true, it needs to be fully investigated by someone outside of Cornell."
Regarding the Snapchat bang bro convention invitation she wasn't aware of:
"Prosecutors were never provided with that screenshot or any of the Snapchat messages."

Excellent post. You are 100 percent correct. Look, the girl was far from an innocent victim, but there are definitely blurred lines.
And people crying about a double standard are being disingenuous about sex. There’s a reason any girl on the planet could find a tinder hookup at will and successful men frequently have to pay for sex.

Don't be the guy who kisses during a gangbang. You are one step away from going gay. Imagine trying to explain that one to your friends.

I don’t have an opinion one way or the other but after seeing her picture the phrase “don’t stick your dick in crazy" comes to mind.

There's a picture of her out there?

What consequences for the crazy gal who was an aggressive participant in all this?
Nothing. Women aren't expected to take responsibility for their actions.

Not only that, he was one of the 2 that was so intoxicated, he had to withdraw from the orgy - to the point that the gal was worried about him...and yet, she went back to sex with him.
Funny how SHE wasn't expelled, no?
The statement she made to police is absolutely insane that she’s fine academically/professionally and these dudes are tarnished/ruined.

She consented to two different three ways, snorted drugs off two erect penises, stayed the night until 11am, suggested yet another three way a week later, asked to go to another party at the same frat house 2 weeks later, said via text ‘nothing illegal happened’, and gave a sworn statement to the police saying it wasn’t rape….and the boys are still getting their lives ruined over this.
Seriously, wtf?!!

White women in this country believe they should never have to be accountable for their actions.
