Thus, those provisions of Title 33 are, by their nature, constitutional.


It'll be interesting to see this play out in court. The clause about adverse effects will be played out for a while, since IIRC St. George area accounts for about 20% of the EBR general fund. Will court agree that this creates enough "adverse effects" to reverse incorporation or will they tell SWB to get bent?

They will win this suit at the LA Suoreme court when the plaintiff bar gets its new errand b----- on the court.

It’s not 20% of the city’s general fund. It’s about 18% of the parish’s general fund.

And it has nothing to do with funding of BREC, Libraries, MARC and all the parish wide independent taxing agencies.

Yeah, if the incorporating area is making up 20% of the city's budget, they don't want to push this lawsuit. It would backfire immensely.

As it stands though, there should be no reasonable argument that an unincorporated area incorporating would have an adverse effect on an existing city.

this goes to show how ignorant she truly is. There needs to be some type of private non-party mediator at these meetings to keep everything above board. The state may need to step in and run this. If you can trust them.

I wouldn’t trust them with JBE at the helm.

All but one of the black members of the Metro Council tried to do an end around to replace Buddy Amoroso with a liberal black Dem thanks to the Governor getting the decision of there was a tie.

He’s also likely to try and ratfrick the appointed StG leadership whether or not he wins the runoff.

That is unbelievable good fortune for St George. Actually I can't freaking believe it still. He is the ONE judge in the 19th that would give St George a puncher's chance.

No one on the state supreme court would be insane enough to overturn the results of an election. That is an incredibly slippery slope.

Prediction: Broome, et al. will request that Morvant recuse himself and that a judge from another JDC (with no ties to EBR) take over the matter. Broome, et al. will argue that, as a purported St. George resident, Morvant cannot conduct "fair and impartial proceedings." Morvant will refuse, but the Broome clan will seek redress with the 1st Circuit/Supreme Court. Delay delay delay is a major part of Operation Sour Grapes.

My prediction is that if they ask Morvant to recuse himself, he will ask for the cast to be reassigned to a different venue.

If this incorporation affects the whole area like she claims, how can Trudy White be any more impartial than Morvant?

Surely this wasn’t enacted thinking Parish President would try and sabotage meetings over services and then file suit on what she is causing. I would also think part of law dealing with services would be more about StG resident making sure of services more than stopping incorporating and shouldn’t be filed by people not living in StG. The city part would make more sense to stop an area actually leaving the incorporated city to form a city or an area the city was in process of trying to annex and had started to provide planning and services to become part of city. This is really neither, and outside of maybe a quick hearing to look for any extremely overwhelming evidence. I can’t believe this was written to be used as delay tactics and bleed citizens financially into submitting.
