I would charge him for being a dumb arse, this happened in June, the guy dies on June 30th.

Now that he has died should I forward the video, post it on tik-tok, or delete it?

The victim didn't have to do the stunt. Maybe if the idiot had pulled a gun on him and told him to do it but that isn't the case.

I don’t know NV law on homicide, but preventing aid like that could amount to gross negligence sufficient to support a negligent homicide charge. Nothing higher.

It appears this is the statute he is charged with violating:

quote:

NRS 202.595

[A] person who performs any act or neglects any duty imposed by law in willful or wanton disregard of the safety of persons or property shall be punished:

1. If the act or neglect does not result in the substantial bodily harm or death of a person, for a gross misdemeanor.

2. If the act or neglect results in the substantial bodily harm or death of a person, for a category C felony as provided in NRS 193.130.


That's a pretty broad statute. The first issue appears to be did the accused "perform" an act in disregard of the safety of the victim? To me, the victim performed the "dangerous" act (cartwheels). Not the accused. The second issue is is there there a legal duty to render aid to someone who is hurt in Nevada? That, I don't know. Generally speaking, one does not have a legal duty to render aid to another.

Sad situation, but probably an interesting legal case

I don't think the charge sticks. The result is sad and the behavior abhorrent, so it feels like it should be punished. Thus, the cops are trying to find a charge that fits.
