Lets talk abuse of maternity leave

My place of business offers chicks 2 months paid maternity leave. At least once a year one of these women gives their notice the day they return from maternity leave. Basically they took 2 months of free money knowing they never really plan on working again.

Shouldnt there be more conditions on paid maternity leave such as agreeing to remain employed with company for at least a year after coming back to work?

Just seems shady AF

And yes, war on women

My wife took 16 weeks of maternity leave, went back and worked 2 weeks so she wouldn't have to pay back her insurance benefits. After the 2 weeks she put in her notice she was leaving Got that check and bounced

Yeah it does. We've got a guy in my office that is away on military leave (so obviously we are holding his job for him). He'll be gone a grand total of 14 months. I just KNOW that he'll come back for a week or 2 and decide he wants to pursue something else and put in his notice.

My wife was instrumental in having that policy revised where we used to work. She flat out wasn't coming back to work after our daughter was born but didn't want to show up two months later and quit.We had bemoaned the unseemliness of this for sometime.

What she did was tell her boss about month 6 of the pregnancy she wasn't coming back. That gave her boss time to hire someone and have my wife spend time training her so when my wife left,there was no floundering around and start up time.

Company modified the position where if you basically leveled with everyone up front,you'd still get your two months.

Would you quit a job knowing that you could take 2 months of pay and then quit? Of course you wouldn't and if you did you would be dumb. The policy allows it and you are throwing away money if you quit before taking the maternity leave. Not to mention, a lot of these women probably do intend to come back to work but then reality sets in when they are getting no sleep and doing nothing but trying to keep this newborn baby alive. Can't blame them for deciding to not come back or to take an extended break before re-entering the work force.

Requiring a new mother to remain employed for any period of time after returning from maternity leave goes against the entire moral and social reason maternity leave was created in the first place. It's a woman's right to quit her job anytime she wants to, provided she's employed "at-will".

Also, if an employer does implement a requirement such as the one you described then that's a form of gender discrimination. If a man doesn't have the same condition of employment then that's illegal. Now --- for those few employers who offer paid paternal leave --- if those implement the same requirement for both men and women then there may be legal ground to stand on.

FMLA mandates maternity leave for new mothers. This is unpaid, job protected leave. There are stipulations on the front end but you can’t implement sanctions around the unpaid leave. Your company offers paid leave as a courtesy, if it’s abused then HR needs to write a policy around the paid portion which they won’t because it’s a lawsuit waiting to happen. Since it has been historically abused (leave as soon as it’s up) it opens the door to discrimination suits.

Of course, but if she doesn't ever plan on working again, why would she care?

And chances are, if she does go back into the workforce, it will be long enough so that the people who remember the shadiness won't be there, so she can still list the place on her resume without worry.
