He did, but I'm behind for the day and haven't heard his testimony for today yet.
He was called by the prosecution in the first trial and now the defense is calling him.
I think the defense team had a chance to talk with this cop about what he saw since the 1st trial.

If allowed, it's basically an instruction to the jury telling them that they are allowed to infer that the testimony of that witness would have been unfavorable to the party that didn't call them, aka the commonwealth in this case.

He seems like a nice guy, and he's nervous. He's a heavy equipment operator, FFS, and not a multi-degreed specialist paid to testify in trials. Hank is being an a-hole to him and I would imagine that it won't play well with the jury.

No court tomorrow due to heat? Bev said the A/C and fans would be too loud and would make the proceedings difficult to hear. So they're off until Friday.
