Who demo'd it? I would expect that contractor did. Does he agree that the pan was installed incorrectly? I'd bet he could find a reason to say that it failed do to defect. Those guys are pretty decent at that sort of stuff.

When I was a kid in the 70s, we had a slow leak on a fridge slowly rot out the floor beneath over time. Insurance stance was they cover one time events, not long developing issues. We had to pay for it.

40 years later, I check my policy each year, and that concept stayed intact, despite the years and miles.

Is there anything on the fact that this work was all done prior to me owning the house and prior to being insured by this company?

Insurance is for sudden and accidental damage(for the most part).

The issue is the "rot" and is usually excluded from coverage. Any damaged that has occurred over time is going to raise red flags for coverage. Now if the damage is hidden even over time then you may have some coverage from that resulting damage.

Now if the maintenance issue caused some sudden damage, usually the demo and repair of the demo is covered but the maintenance issue itself would not be covered(ie a leaky pipe- no coverage for the pipe but coverage for the drywall removal to access the pipe)

Unfortunately your only options are:

1. Pay for it yourself
2. Try to go after the previous owner if you can.
3. Make a phone call to your inspector who inspected the home prior to your purchasing it.


Look, I know it sucks but unfortunately you can’t fault your insurance company here. None of them cover mold that occurred over a long period of time like in your case.

A home inspector cannot see through walls or underneath tile and will have a disclaimer stating such.

Recommend you file a complaint with the Insurance ommision of the state of Louisiana. ,. Copy the. Insurance company. Keep us advised

In your case, the mold is caused by some faulty installation and occurred over time.

Now, if a tree falls through your roof and rain water enters your home causing mold, then yes, that would be covered, assuming you filed the claim in a timely fashion and didn’t just let your roof sit with a hole in it.

Maintenance issues are NEVER covered by homeowners insurance in Louisiana. You could have some Mickey Mouse operation homeowners insurance company or you could be covered by the best company in the industry —- they would ALL deny your mold claim.

Yes, it sucks for you because now you have a large and expensive project on your hands but you have to understand that mold is 99.99% of the time going to be denied.

No because more than likely you bought the home “as is”. This will be clearly stated on your purchase agreement.


I know it sucks, but welcome to home ownership. This is a maintenance issue.

Almost all insurance companies have gotten tougher on claims even legitimate ones they make you jump through hoops. Even state farm. The adjuster is not your friend.

Insurance policies are contracts. Would you pay someone outside of what you owe in a contract?

If coverage falls under that contract the vast majority of adjusters and carriers pay well, many too well.
