Getting Slightly F*cked by Home Insurance

So I had a leaky shower that built up mold and caused some water damage to my laminate floors in the adjacent bedroom and rotted out the 2x4s. Insurance adjuster comes out and says that the fault is due to shower pan failure or wrapping of the bench. This is a tile shower so we have to demo the whole thing. Now insurance comes back that they won’t cover anything since it’s due to faulty installation (by previous home owner)

I’m fricked arent I? Anything to do to put this on a previous home owner prior to going under contract with this company?

That's total bullshite. They insured the home as you bought it.

We didn't know what we would do, we called up USAA though, their friendly representative greeted me like they always do. Hello General BillyMaysHere, thank you for your service and what can we do for you?

Within hours they had an adjustor out and were able to diagnose the problem as well as provide us a check to cover estimated repairs.

We are USAA members for life!

It seems like they will replace a roof like there is no tomorrow after the smallest of hailstorms yet fight you on all kinds of other stuff like this.

Just tell them you're going to sue them for the amount of the repair.

I had two bathrooms that needed to be redone, because a toilet had a slow leak, and rotted out the floors over time. Their justification was that I should've noticed the slow leak so they weren't paying for it

Say that and they will automatically transfer you to the Litigation department and I can damn well guarantee you that you will never get the claim. Threatening them with a lawsuit is the last resort, not the first.

Might be worth getting a second opinion from a licensed contractor and see what they say.

That's insurance in a nutshell. Pay into it for years, then when it's time for them to pay up...all of a sudden it's a problem.

Maybe. Maybe not.

When you're looking at thousands of dollars of repairs and possible mold issues and insurance is throwing blame on the previous owner trying to leave you in the lurch, spending a couple of hundred bucks for an hour of a real estate (or other applicable specialist) attorney's time to advise you seems prudent, doesn't it? Remember, you now have a paper trail of a history of mold that's going to follow that house.

Get competent advice.

ETA: Just in case you are unsure, the OT is NOT competent advice.

This. If you can get a licensed contractor to contradict the "opinion" of the adjuster then you'll be in a much better position to discuss coverage.

I legit have his same conversation with customers every week.

Mold, in your case, is never covered by homeowners insurance, regardless of company.

SUDDEN & ACCIDENTAL

If it’s not sudden and/or accidental then it’s not covered. Period the end.

In your case, the mold is caused by some faulty installation and occurred over time.

Now, if a tree falls through your roof and rain water enters your home causing mold, then yes, that would be covered, assuming you filed the claim in a timely fashion and didn’t just let your roof sit with a hole in it.

Maintenance issues are NEVER covered by homeowners insurance in Louisiana. You could have some Mickey Mouse operation homeowners insurance company or you could be covered by the best company in the industry —- they would ALL deny your mold claim.

Yes, it sucks for you because now you have a large and expensive project on your hands but you have to understand that mold is 99.99% of the time going to be denied.

I work in HO insurance, on the claim side(Contents, not structure, sorry op) and its amazing the amount of people who come into a claim fighting and threatening lawsuits prior to any action being taken by insurance company. Thats like yelling at your server before you get your food.
