A while back, there was a local guy that heard his doorbell at like 3am. He grabbed his gun, went to the door, opened it a crack and this guy was asking to use his phone. He saw a guy out of the corner of his eye with an AK-47. He closed the door, told his wife to get back, flung the door open and started firing. He killed the guy with the AK-47 and the other guy who rang the doorbell ran back to the car. He was so startled that had the car in neutral trying the leave. The homeowner put a few bullets in him, then they guy eventually sped off and died down the road.

The owner was cleared for shooting the armed guy, but had to go to court over the guy who rang the doorbell running away who wasn't armed. He obviously won his case, but had to pay a ton in legal fees.

If courts started putting legal fees back on the plaintiff you'll see a big change

This sounds very Forest Park.

Edit: Rockdale Co., so more like Lithonia, but, yeah.

People can sue for anything. Doesn’t mean they’ll win. Good shots.

I guess the parents expected him to just let the teens kill him. take all his stuff, and do with his family whatever they wanted.
Just like they should have expected the lawyer they hired to laugh behind their back while collecting his paycheck full well knowing this is going nowhere.

You can sue anyone for any reason…they will not be successful in collecting damages. If I were the judge, I would make the parents pay for the door they. Kicked in.

Do you mean make the plaintiff pay the defendant's legal fees?

True, with a caveat.

Lawyers are generally subject to discipline (on someone's complaint) if the case is truly without merit.

No lawyer who wants to keep practicing files anything without some basis, flimsy or no.

Problem is, this homeowner probably will have to fork over $50k in lawyer fees off the bat just to have an attorney draw up a response and appear for him to have the case thrown out, and the suing parents who likely hired some POS sue happy pro-bono unless awarded lawyer won’t have to reimburse him a single dime.

I'm sure he'll receive some financial support given the near unanimous support he has.

Finding an effective countersuit argument should be one of their top priorities. They could likely make the parents regret the decision to sue if they find grounds to countersue, even if flimsy.

There are way more frivolous lawsuits thrown out with prejudice than there are disbarred attorneys. Do the math.

He was cleared. Stand your ground law applies. What kind of absolute dumb mfers think that their sons dressed in black, hoodie and beanies with masks and gloves with handguns trying to break in was okay enough that when they FAFO , she thinks she can sue the owner of the residence for defending himself. What kind of fricking sub human with no brain thinks like this is even allowed to roam the earth?

I'm a lawyer, I don't math.

Seriously, though, what the public thinks is "frivolous" v what the actual definition is constitutes a bit of a gulf.

I saw the front door house cam of the incident and saw what they were trying to do. They were coming into the door trying to bust it open. I saw how they were dressed with guns in hand. The owner vocally said "Frick that" and started T'ing off on these scumbags with what I thought was a shottie. 2 of the 3 got airlifted straight back on contact and the third tried to run but didn't make 3 steps(already had lead in him). I cant stand this type of typical behavior. Its always the usual suspects.
