The guys was nails on the first test. Then the a-hole reads a 10 page instruction like he’s a speed reader. I had a cop tell me once the reason they do the backwards alphabet is to get you to say “I couldn’t do that sober”. It’s hard to say no, but you should always refuse the tests.

When watching it again, the guy kept doing the initial test correctly, yet the dickhead cop kept repeating the instructions. The guy passed the tests drunk or not.

The fact that cops/LEO can lie during an interrogation and it is a crime if anyone lies to them during incrimination (I mean interrogation, Freudian slip) is comical. They tell everyone else to talk, but let an investigation into police activity occur and they ALL get lockjaw.

I've heard the horizontal gaze nystagmus test is bullshite but Johnny Law thinks it's science and he's the scientist.

The horizontal gaze nystagmus test relies on an officer’s close observations of minute eye movements that occur at certain angles. While an officer will receive training in performing this test, the officer is not a trained medical professional and may not be able to recognize certain conditions that may cause nystagmus in sober people.

I had to take one to leave a company function once. I haven’t drank in quite a few years and couldn’t pass it.

A defense lawyer friend told me to play to the camera …keep explaining that the instructions aren’t clear and the tasks are a little difficult to properly complete…this will give your lawyer plenty of opportunity to argue for you

It is? I know it is with federal agents, not with regular cops.

So, when they ask if you've been drinking, do you lie, or plead the 5th? Because pleading the 5th will be interpreted to saying yes. Then, if you say no, and they smell it, they just assume you're lying.

Also, I've heard that if you refuse the tests, they suspend your license for a year regardless. Is that true? And if so, is there anything an attorney can do to get you out of it?

Fortunately, I've never been pulled over after drinking, but I've always wondered what I should do if pulled over.

Easiest thing is to just ask for the breathalyzer (assuming you haven’t been drinking) instead of doing all the roadside tests.
