Should the property owner be responsible for not securing the plant or is it on the people trespassing?
Terrible story, but the fault should always be on the person trespassing.

Hell, a lot of us can think back on things that we did as young people and marvel that we’re still alive.

Ain't this the truth. I did way too much dumb shite, yet I'm somehow alive. Even more impressive is I don't have a criminal record.

I feel for the family. 38 year old me says it's a bad idea to go exploring an abandoned industrial building at dark. 18 year old me would be all over that.

Tell that to the homeowner that was sued by a thief that had broken into their home and made the unfortunate mistake of opening a door and stepping into the "room" that was actually the basement stairs. The court found "negligence" on the part of the absent homeowner and the thief found a new payday.

Absolutely

But don’t sue the ever living shite out of somebody when something bad happens to you

Exactly. You may score high on your ACT/SAT, be valedictorian of your class, but can still be a complete moron when it comes to every day decisions, especially when under the influence of whatever you might have imbibed in that particular evening.

I'm a "smart" guy, at least according to my tests results, but I've done plenty of stupid shite. Especially in my younger years.

Read the thread again, Brohammer.

No one's claiming that "he broke into an abandoned building, he deserved to die!"

They're just saying that there's really no one else to blame but himself for the outcome. Those are two different sentiments, especially when the question posed in the OP is "Should the property owner be responsible"

What was he doing to have deserved what happened?

I didn't say he "deserved" anything.

The fact is he is dead because of his actions.

The response should be to morn his loss but not to try and shift blame to someone with deep pockets.

I tend to agree, but I'm pretty sure that the guy who owns this piece of property is the same guy who owns the abandoned Naval Base property in the Bywater that has been the location of multiple deaths as well. Also the same "someone with deep pockets," who owns the Plaza Tower downtown that is falling apart and nearly killed people from falling debris.

At some point the city needs to come down on that guy and make him secure his dilapidated properties.

None of these properties can be sold, it costs more to take down the structures on top of them than the property is worth.

This is a sad situation but is not the fault of anyone but the kid that died.

Unfortunately, this is the case. Sometimes as a teenager you do something against the rules that seems pretty harmless, but turns out to be tragic. The kid had a full scholarship to LSU for chemistry too. Such a waste.

Walker described her son Monday as “poised” and “intelligent.” He received a full-tuition scholarship to Louisiana State University to study chemistry and was planning to begin school there as a freshman this fall, according to Walker. Clawson also worked as a waiter this summer at Antoine’s, and Walker said she remembers visiting the restaurant recently and heard his coworkers rave about him.

People say shite like this it absolves them of everything.

I'm sure he was very fricking smart. Probably well read, really bright, great demeanor. But he did a dumb fricking thing and paid a price.

There are many times on which I look back at what I did as a kid and realize that one wrong move and I could have died. And in almost every instance I was doing something that was unnecessary.

That isn't to condemn the kid. If he lives, this is a fun night they remember forever. A very real payoff. The type of shite people probably think about on their death bed or when they relay stories to their grandkids. But every time a store like that is told, there's a different version out there drifting in the ether that, by sheer luck, missed the storyteller. This time it looks like he should have worn clothes that weren't so apt to catch on things floating.

Yep. Did a lot of crazy teen stuff, but always recognized if caught or hurt, I was in the wrong. My parents felt the same.

He was trespassing. The property owner should owe his family zilch.

Nope bit they sure do make sure the kids are flaming liberals.

The fall is all on him for trespassing. Sure a law suit will be coming though.

H. The provisions of any other law notwithstanding, owners, lessees, and custodians of structures, watercraft, movable or immovable property shall not be answerable for damages sustained by any person who enters upon the structure, watercraft, movable or immovable property without express, legal or implied authorization, or who without legal authorization, remains upon the structure, watercraft, movable or immovable property after being forbidden by the owner, or other person with authority to do so; however, the owner, lessee or custodian of the property may be answerable for damages only upon a showing that the damages sustained were the result of the intentional acts or gross negligence of the owner, lessee or custodian.

The "gross negligence" part is where sleazebags like McKernan come in to play.

Lots of wiggle room in that code article (and
a few others that could apply), bro.

Of course, I'm making no statement as to whether or not a suit will be filed here, or the potential chances for success if one is, though. And certainly no statement as to whether or not such a suit SHOULD be filed.
