Boston DA lists crimes she won’t prosecute

Newly elected liberal DA in Boston is on the “cutting edge of Justice Reform” and has published a list of cases her office will auto decline. Can’t wait to see what this does to the crime rate. Especially the Possession With Intent to Distribute cases. She has basically legalized drug dealing.

Charges for which the Default is to Decline Prosecuting (unless supervisor permission is obtained).
Trespassing
Shoplifting (including offenses that are essentially shoplifting but charged as larceny) Larceny under $250
Disorderly conduct
Disturbing the peace
Receiving stolen property
Minor driving offenses, including operating with a suspend or revoked license
Breaking and entering — where it is into a vacant property or where it is for the purpose of sleeping or seeking refuge from the cold and there is no actual damage to property Wanton or malicious destruction of property
Threats – excluding domestic violence
Minor in possession of alcohol
Drug possession
Drug possession with intent to distribute
A stand alone resisting arrest charge, i.e. cases where a person is charged with resisting arrest and that is the only charge
A resisting arrest charge combined with only charges that all fall under the list of charges to decline to prosecute, e.g. resisting arrest charge combined only with a trespassing charge
Instead of prosecuting, these cases should be (1) outright dismissed prior to arraignment or (2) where appropriate, diverted and treated as a civil infraction for which community service is satisfactory, restitution is satisfactory or engagement with appropriate community-based no-cost programming, job training or schooling is satisfactory.

Well if her office isnt going to prosecute them then how about giving the power to the people

And is it really her place to decide? If we don’t want these to be crimes why can’t we just vote to decriminalize them.

Read the whole thing, you can still get civil infractions like fines, restitution, and community service. You just won't get jail time.

Worth a shot. You may be surprised about that crime rate. Instead of sending people to prison to learn more about becoming a criminal as well as making it very difficult for them to get a job, make them donsome community service and try to actually rehab them into society. The end goal shouldn’t be punishment but a more peaceful and prosperous community as a whole. Why not try something different.

THIS is the crux of the argument. There is Prosecutorial Discretion for weak cases or exceptional circumstances but how does an elected official take the Oath of Office with the intent to not fulfill their duties? You can’t just blanket decide not to follow the law. That ain’t how it works.

All prosecutors have discretion to allow pre-trial diversion and to not prosecute certain crimes under certain circumstances. There's nothing really wrong with that if done reasonably. But announcing, up front, that it's basically The Purge for misdemeanors is pretty stupid.

So, I can hang out in her back yard, snort some blow, steal $249 from her purse, threaten to kill her family, fight with the police when they get there, and they just let me go? Awesome!
