That is my whole issue with this deal. Where is the notice of investigation? Where is the hearing? What happened to due process?

Not just penalize. They’re trying to arrange it to where they can freely kick out ANY school of their choosing with no evidence, investigation or right to defend.

They can already do that; it just takes the requisite number of school presidents to vote for it. It's part of the charter, I believe.

Yeah, not without that institution filing suit against them. That’s why the SEC is asking the court to issue a TRO and permanently enjoin LSU from filing a suit. Personally, I don’t think a court will do that.

I think it’d be great if LSU’s representative walked into tomorrow’s meeting and asked to speak first. Then call their bluff and state that LSU is willing to voluntarily withdraw from the Southeastern Conference.
You’d get a lot of shocked looks and stammering. “Whoa, whoa, whoa, let’s just hold on there for a second. Let’s not be hasty about any of this.”
These presidents want to flex, but know that any drastic moves will ultimately affect their bottom lines.

I'd like LSU to walk in with an early termination buyout fee that they expect if expelled. If LSU tried to leave the Conference early then they would require LSU to pay a buyout fee. Why should they be able to kick us out without paying us?
I think LSU's share of the media rights deal for the remaining years of the contract would be fair.
For this Conference thing to work, there needs to be stakes on both sides. You can't have it where the Conference can hold an Institution hostage from leaving unless they pay a buyout, and the Conference is also able to expel a school without having to pay the school.

As the Amended Complaint notes, Section 3.1.5 of the SEC Constitution and Bylaws grants the SEC's presidents and chancellors "plenary power and authority with respect to all affairs of the Conference of any type or nature whatsoever." The bylaws explicitly state that the leaders may take these actions "in their sole discretion." There is no requirement for a separate, trial-like hearing before a vote.
Thus, the procedure to issue penalties requires only two steps: (1) the SEC Commissioner issues a notice to call a Special Meeting of the conference leaders (Special Meeting is set for September 10); (2) at least two-thirds of the conference leaders (11 out of 16) must vote in favor of the penalties.
While LSU cannot legally block or delay the vote to demand an internal "fair trial," LSU leadership could use the scheduled meeting itself to argue their case informally to the other school leaders before those leaders cast their votes. However, I'd expect that the other 15 leaders would already have their marching orders or their minds made up before appearing at the meeting. I can't imagine an informal argument by LSU would make much difference.

And they’re a non-profit, which requires them to act in good faith. This isn’t good faith by any stretch of the imagination.
