I dunno? Just seems that if the shooting itself was not legally justified, he could also be charged for the reckless/negligent discharge of a firearm with an innocent bystander mere inches away from the bullet’s path.
Again, dependent on the shooting’s justification.

I lawyer could maybe get a doctor to say it was a very good possibility that the shooter was concussed from the punch to the head. Possibly argue shooter acted irrationally immediately after a brain injury and wasn't in his right mind.
