Republicans in the Louisiana House advanced a bill Wednesday that would classify abortion as homicide and allow prosecutors to criminally charge patients, with supporters citing a draft opinion leaked this week showing the Supreme Court ready to overturn Roe v. Wade.

The legislation, which passed through a committee on a 7-to-2 vote, goes one step further than other antiabortion bans that have gained momentum in recent years, which focus on punishing abortion providers and others who help facilitate the procedure. Experts say the bill could also restrict in vitro fertilization and emergency contraception because it would grant constitutional rights to a person “from the moment of fertilization.”

Discussing the legislation less than 48 hours after the leaked Supreme Court draft proposing to overturn the 1973 ruling that has protected abortion rights, lawmakers and advocates who spoke in support of the bill appeared energized by the prospect of a long-sought imminent victory. One advocate who helped draft the bill specifically cited the draft opinion.

“The Supreme Court is poised to ignore Roe versus Wade,” said Bradley Pierce, executive director of the Foundation to Abolish Abortion.

He appeared at the committee hearing with the bill’s sponsor, state Rep. Danny McCormick (R).

“We’ve been waiting 50 years to get to this point,” said McCormick, who did not respond to a request for comment.

Not seeing a problem with this.

If abortion is thrown back to the states, the state is able to handle it how it wants to.

Louisiana's current trigger law isn't really a deterrent. It's like getting a speeding ticket.

Good. They should make sure to include women who travel out of state to get one. If the unborn child is a person whose rights should be protected, it's only logical to conclude that the unborn child is a resident of the state of Louisiana, and the mother should be prosecuted in a LA state court even if she travels to California to have the abortion.

Absolutely. Many states treat the unlawful killing of an unborn child as a homicide right from conception. Homicide is defined as the killing of a person by another person. If the unborn child is a person, it's a person whether it gets killed by a drunk driver or an abortion provider. It's a person regardless of whether the father is the boyfriend of the mother, the father of the mother, or the rapist of the mother.

People can tapdance around this all they want. Saying that whether or not the fetus is a person depends on who the father is or how it was killed is beyond stupid.

It's a double murder if you kill a pregnant woman and the fetus dies as well. How does the mother doing it, instead of a 3rd party, make it any less murdery?

The current nightmare is the state sponsored / condoned murder of millions of innocents - I'm willing to take a chance and work out the enforcement 'nightmare' as opposed to the murder nightmare.

I personally am totally on board with outlawing post-viability abortions...which is essentially the situation in the US even in a Roe environment. Do I think it's homicide? eh. Late 3rd trimester feels that way, yes. Of course, those are already illegal and are extremely rare.

But acting like the morning after pill is murder is obviously crazy and obviously nobody actually believes it.

I would, in turn, ask you: do you actually believe an early 1st trimester abortion is "murder"?
