Practically everything a president does is official, their life for 4 years is the presidency unlike other politicians. That’s why broad immunity exists for them. Otherwise the possibility of some legal entity coming after would be very high. Presidents and their staff would be constantly second guessing decisions.

Kind of a separate thread, but

Bush lied to congress to induce war with Iraq.

Really isn't fair to Bush, despite all his faults. He was lied to and manipulated by our intelligence agencies to believe what he told Congress was true. There's plenty to shite on him over, but this one ain't it.

As president Biden has helped facilitate an invasion that has lead to the deaths of American citizens.

Should this case go through, every ex-president will stand trial.

Apparently the DOJ, aka Biden's lawyers, were arguing that Trump is an isolated case.

Ummm, it doesn't work that way. Either it's selective prosecution or every president will be hauled into court. Neither is acceptable.

This court doesn’t care about oral argument in this case. They’re going to punt…

Correct.

Otherwise, you are operating under a presumption of guilt, which is antithetical to our system of Justice.

In other words, this farce is a political persecution, nothing more.

His lawyer is arguing that everything is ok if it’s “an official act.”

So Biden can do whatever he wants if trump wins this case.

It’s a dangerous strategy, no?

Of all the cases against trump the immunity argument is his weakest one.

Trump was using his office for private gain, to remain in power. He peddled conspiracy theories that vote tallies were incorrect and wanted Mike Pence to refuse to certify the vote based on that assertion.

He either really believes that, or surrounded himself with complete unpatriotic morons who screwed him over.

Either way, that was not an official act on behalf of the country.

Imagine living in a country where the govt, illegally put in place, can then use all their powers to prosecute their opponent at federal, state, local levels simultaneously, during an election to bleed him of finances, and prevent him from campaigning.

It worked for them in Pakistan, Brazil, and numerous other countries, why not at home?

Not only are they fabricated, in some cases they actually changed/enacted policies and laws to retroactively then make it illegal. The sexual charge in New York, the classified documents, where the DOD supersedes the presidential powers.

It really saddens me that we have skipped right past the basic rights of any American and instead are caught up in nebulous innuendo about court maneuvering and legal nonsense ad nauseum.
