Same.
Sadly, it probably requires a constitutional amendment - although, Congress could pass a statute stating that 3 strikes is presumptively "bad behavior" for purposes of impeachment.

It used to be, if you were deported, your anchor babies went with you and could return, if they wanted, as a legal adult.
Unfortunately these folks probably have 4 times their number in anchor babies, will be allowed to have a "sponsor" and continue to collect benefits as a refugee.

So who leaks the BC decision over the weekend to see how bad the reaction will be?

defanging the activist judicial "review"
How does this translate to real world practice? Like, what things is this addressing?
Honest question, I don’t know anything about this case

In the decision:
quote:
Writing for the majority, Justice Samuel Alito wrote that the language of the TPS statute prohibiting judicial review “is clear, and its plain meaning is very broad.”
he stated that the the TPS statue was written into law "prohibiting Judicial Review" so the judicial cant rule on the merits of ending TPS status by the executive branch. however, on other constitutional areas, the judicial can review the actions, but the 2nd part of the decision also stated that because the administration was uniformily trying to end TPS as a whole, that the claim of "racism" in that decision by Hatians “will likely fail”
quote:
And although federal courts can review the Haitian TPS beneficiaries’ claim that Noem’s decision to terminate the designation for Haiti violated the Constitution, Alito added, that claim “will likely fail” because there is a “strong” explanation for Noem’s decision that has nothing to do with race: as the challengers themselves argued, Alito said, the Trump administration “has terminated every TPS designation that has come up for renewal” and “simply opposes the TPS program, at least as it has been implemented in the past.”

Are we getting the Mississippi Election Day case this month?

quote:we need a statute that anyone who has passed through a 3rd country to apply for citizenship by rule gets rejected automatically and cant apply. you are not meant to be able to asylum shop, its supposed to be the next country you arrive to where the supposed source of oppression is not present.
“Supreme Court Rules Illegals Outside The US Have Not Arrived In The US”
“The U.S. Supreme Court ruled that a non-citizen has to physically enter the boundaries of the U.S. in order to have “arrived in” the country for purposes of asylum.”
This should be obvious to everybody, but of course the 3 liberals voted against it. They legislate from the bench and could care less about the constitution.

Kagan is incredibly intelligent and thoughtful. Even though I frequently disagree with her, her opinions are always well researched, well argued, and well supported by precedent. If you want to understand progressive views from a non-cultural marxist race-baiter pov, read Kagan SCOTUS opinions.
Sotomayor and Jackson are absolute morons for whom I have zero respect for.
Agreed. That's why when I see a 6-3 decision I figure the dissents were Justice Kagan, Justice Wise Latina & Justice Diversity Hire.
Kagan will back her stance with case law, the other two with what amounts to their feelings.

6-3
What's funny is Leftists tried to pin this on Trump. The TPS status was rescinded under Biden and they then challenged it and got a 1 year reprieve.
All the onus was on the Haitians. Under that TPS tag they are informed that if they seek to remain in the US permanently, they must file for legal immigration status during their TPS time here. They never did.

The phrase "wise Latina" refers to a famous and controversial quote by Supreme Court Justice Sonia Sotomayor during a 2001 speech at UC Berkeley School of Law. She stated: "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."
Wasn't aware of that but Obama made the reference when he nominated her.
Which gave rise to 1,000s of "Wide Latina" jokes.
