I've been lucky that alcohol just really isn't that big with any of my family. Social drinking at a party or tailgate is about it for us.

As horrible as all that is, what you're talking about is self destructive. With guns we are talking about harming others. If both are just as bad, I'd be fine with heavy users of either not owning guns... If it were enforceable in a way that makes sense, which it's not

So serious question here as I'm uneducated on this. If someone in Louisiana has a medical marijuana prescription and attempts to purchase a firearm, can that individual just lie on the question that asks about marijuana use, and the seller will not be able to find that the person has a MM license in the state inventory? I thought that was easy to determine with a simple background check but maybe not.

Yeah, thats why I never would go the Medical route.

I saw this coming a mile a way. If they can get mJ users banned, next will be adhd medicine and go from there. If they can’t take your guns, make it illegal because of medicines.

Yep. Govt will backdoor a way to ban firearms from large numbers of folks if we let them start.

There are. From the founding (and before), it was understood that the state could disarm some people. Historically, these are people that posed a threat to the state itself like Catholics, but grew to include people who pose a threat generally like convicts and mentally incompetent.

Citing a state law does not address the argument. People in this thread have an absolutist “shall not infringe” position. Now that the 14th amendment has made the 2nd amendment apply to states, you can’t say this is solely a state issue.

On the background check form, there is a question that ask if you are an unlawful user of recreational drugs.

If you smoke dope and answer no, you are committing a felony.

This scenario is questionable because of the 4473:

Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?

Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.



If you are purchasing a firearm and you put "no" but have a medical card then they theoretically could come after you for lying on the application.


The bigger issue is that if you get a medical card after you have purchased the gun then that makes you unable to own the gun. It's the big part that makes the federal law and certain state laws clash because you already own a gun in a state that allows medical use so you are within the states jurisdiction. The state says it's fine. However, you are running afoul of the federal law because the feds say you can't.

For instance. Some states have laws that explicitly allow ownership yet the feds say they can't. Most set the restriction at possession of both the firearm and the marijuana at the same time in the same place. But since the 4473 is a federal form so you would have to lie to the feds in order to exercise your rights grated by the state.

I know. It's not a well worded question these days considering the legal ambiguity of things like delta 8. Not to mention someone who purchased a gun before introducing THC to their consumption would be in a legal gray area as well.

Until MJ is legal federally people who smoke it are already banned from firearm ownership.

I think Whiskey and guns have a pretty long and bad track record; the slope is slippery when wet.

If they take aim at grass, booze won't be far behind and soon only Mormons will be packing.
