We don’t know that for certain, but what is certain is that the list of things to fit in before the election is now almost certainly too long and protracted to shoehorn a trial between now and election time - most definitely primaries and very likely same for the general. Could the district court judge force it to happen, perhaps, but it would be so blatantly obvious what the judge is attempting to do from a personal bias standpoint that, well, it’s just highly unlikely.

I think you're wrong. I don't take notes while participating in these threads but my recollection - the vast majority of DeSantis primary supporters are like me, absolutely not cheering for Jack Smith, quite the opposite in fact.

And so they don’t have to answer the brief filed by Ed Meese team? They challenged the constitutionality of Smiths appointment. Said there is no law for him to authorize his existence as special counsel.

There is no way to know. Since SCOTUS denied the motion for certiorari before judgment (nobody in the legal profession should have given that more than a 1% chance of happening) the question of immunity drops back to the U.S. Court of Appeals for the District of Columbia where the arguments on the issue are set for January 9. Then it depends on the expediency of the appeals court in making their ruling and then how quickly SCOTUS deals accepts or denies cert in the guaranteed appeal to them. Something like this could move very quickly or very slowly just depending on how much emphasis on speed the two courts give it. The issue of immunity could be resolved by the end of January (especially if SCOTUS denies cert) or it could be still up in the air this time next year.

Trial was already scheduled 2 days before Super Tuesday.

Even if 9th Circuit expedites it, Orange has one appeal option before going to SCOTUS.

So yea, no way it gets heard before Super Tuesday. Not to mention all of the other cases Smith will have to reschedule around.

They can present an amicus to the DC Circuit (where appeal is pending). That court is imposing very abbreviated briefing delays (Trump's brief is due tomorrow, I think)
