Huge win for the 4th Amendment.
Is it? Should we be happy police can't use geofence data to find people who were in the vicinity of a crime when the crime took place? What's next, they can't use video cameras in an area where a crime took place?

My understanding from those that watch the Court is that BRC isn't coming today. But who knows

Court says asking for Geofence data IS a 4th Amendment search So police need a proper search warrant for that type of information
I think the question was whether those general warrants are constitutional. The way it works is the warrant demands a company like Google provide the locations, texts, emails, etc of EVERYONE that entered into an area near a crime scene during a certain timeframe. It’s a problem because it sweeps up a lot of innocent people

she gets here case heard in the lower courts while holding her position. still leaves open that this case could be reheard once the lower courts make a judgement

court said that putting requirements like "for cause" violated the separation of powers. basically killed the 1935 USSC ruling "Humphrey’s Executor,"

Seems like a strange ruling, because they did obtain a warrant in this case.
They remanded to the lower court to determine if the search was reasonable and supported by probable cause, so the use of Geofence data might still be okay for that case.

Yeah, if someone robs me at gunpoint my biggest concern is definitely whether or not the government will see my text messages during the time of the crime.

You really can't think of a situation where this is a bad thing?

Well republicans better learn to play fricking ball then. When the democrats show up with a truck full of ballots, show up with an even bigger truck with more ballots. Nobody said it was fair but life isn’t fair, the USSC basically told the good guys we have 5 days to print ballots and dump them. So let’s out cheat the commies, they’ll be clamoring for election changes soon after.

Right

No, I can't see a situation where it is a bad thing that law enforcement can see who was in an area at the time a crime took place and develop a list of suspects from that information.
"We know the crime took place at this time, and we know it took place at this location. Oh well, too bad no one saw the suspect. Now we'll never know who did it."
Only result of this is fewer crimes will be solved. Let's just keep making it so difficult to investigate and solve crimes that no one ever goes to jail.

To be fair, it really doesn’t matter if a crime is solved because most DAs and judges won’t send anyone to jail anyway.

Is that what you think is happening? Very shallow thought process there.

That would be the appropriate decision imo. Anything beyond that would venture into “legislating from the bench” territory.

Not really. There's no way to write a warrant to say "we want this one guy's cell phone data" when you don't know who the guy is.
