you serioisly think there are documents showing a drinking problem???

seriously???

I think there's enough anti-MAGA people in DOJ/FBI that a diligent reporter could find a few people to produce a "memo to self" email which details embarassing drinking problem stories. Even if the stories are completely made up, putting it on paper and giving it to the reporter while representing them to be true, is likely enough to defeat the lawsuit on summary judgement.

This. Which is why I am 100% sure they are going to settle and pay up so it never goes to trial.

They won't be.

You're quoting The Atlantic and calling someone else out as stupid.

There's a hilarious irony if I've ever seen one.

a huge tell that this is a bullshite lawsuit is that it was filed in DC Federal Court.

Good point. Patel filed the lawsuit… In DC.

Because it provides a convenient excuse to blame the Judge if he loses.

Can’t blame him for that. But it’s all bloviating theater.

Patel is so full of shite that maybe he believes his own bullshite now…

There is nothing illegal or even wrong with the guy drinking beers. The Atlantic is going to have to prove that his beer drinking is somehow problematic while his defense points to the record setting stats the FBI can tout under his leadership.

There is nothing illegal about Patel drinking. There is nothing illegal about him drinking until he passes out. Patel just doesn’t want anyone to report on it.

Honest question for you.

On a scale of 1 to 10 -

What are the chances that The Atlantic would be totally surprised that Patel is filing a lawsuit?

With 1 being the least surprised and 10 being the most surprised.

Problem for Kash is that the Atlantic does not have to prove anything.

Kind of depends on the wording of the article.

Carol Burnett famously won a defamation case against the Enquirer who outright claimed she was drunk in public rather than hinting at it.

The legal team at The Atlantic should theoretically have softened the language not to put themselves at risk, but as we have seen, many media outlets aren’t particularly careful on shite like this.

Wait!
You suppose the claim Patel is exposing these accusations to discovery in court in a case he cannot win is a "good point"?

Really?

Sounds like you’re confused on my post and are laughing out of ignorance.

The point is not about choosing to file a case. It’s about where, the LOCATION.

Doesn’t this admin rail against DC judges regularly? So choosing DC as a venue to file the case might just get a judge they don’t like and can rail against some more as being the REAL reason they lost. (If he loses).

Whether the accusations turn out to be true or false is irrelevant. Fitzpatrick only has to maintain and stipulate that she was told they were true and did not have any knowledge of their falsity prior to publishing.

She and The Atlantic are in the clear. The downside for Patel is that he keeps protesting the story. Patel should have gotten out in front of the story and this would be a non issue. Cheaper for whomever. Patel, The Atlantic and whoever is bankrolling Patel

She won it in CA courtroom. Patel filed in a federal court. Federal Courts have placed a high bar on libel.

All of that, and even more, yet idiots like the two dysfunctional lawyers here still cant figure it out.

Either that, or they simply don't care what the truth is.

Did you read the Atlantic article?

Can you name a story the Atlantic ever got near the truth? The premise of the story is two-fold...

Patel is soon to be fired. Because the author presumes Trump despises drunks and Patel is a drunk.

The author presumes that Patel drinking at Mar-A- Lago and Patel doing a traditional beer chugging in a locker room... Angers Trump as his brother died from alcohol poisoning.

The former FBI insiders are the Seraphin group that dishes about Patel constantly. Their jobs are to divide MAGA.

Patel is said to workout twice a day. Drunks generally dont work out twice a day.

Sorry some snot nosed dweeb from the Atlantic thinks beer chugging and partying are beyond them...thinking Trump will think it is trashy.

Who hasn't went to bed drunk from a wedding bachelor party? If this accusation is even true...The author tells a fevered dream tale that FBI Directors are to be on call 24/7- 365.

Did any of you review this thread where a lawyer that handles these cases explained why the case is impossible to win?
