I think there's enough anti-MAGA people in DOJ/FBI that a diligent reporter could find a few people to produce a "memo to self" email which details embarassing drinking problem stories. Even if the stories are completely made up, putting it on paper and giving it to the reporter while representing them to be true, is likely enough to defeat the lawsuit on summary judgement.
This. Which is why I am 100% sure they are going to settle and pay up so it never goes to trial.

Kind of depends on the wording of the article.
Carol Burnett famously won a defamation case against the Enquirer who outright claimed she was drunk in public rather than hinting at it.
The legal team at The Atlantic should theoretically have softened the language not to put themselves at risk, but as we have seen, many media outlets aren’t particularly careful on shite like this.

The point is not about choosing to file a case. It’s about where, the LOCATION.
Doesn’t this admin rail against DC judges regularly? So choosing DC as a venue to file the case might just get a judge they don’t like and can rail against some more as being the REAL reason they lost. (If he loses).

Whether the accusations turn out to be true or false is irrelevant. Fitzpatrick only has to maintain and stipulate that she was told they were true and did not have any knowledge of their falsity prior to publishing.
She and The Atlantic are in the clear. The downside for Patel is that he keeps protesting the story. Patel should have gotten out in front of the story and this would be a non issue. Cheaper for whomever. Patel, The Atlantic and whoever is bankrolling Patel
