NYC subway rider that killed someone in self defense has charges dropped

Good news and a rare act of sanity out of NYC. Not sure why this guy is rightfully exonerated while Daniel Penny is still facing life in prison.

Imagine if the races were reversed. Also notice the wording "a rowdy ex-con". If I remember in the Perry case the guy he was charged for murdering was some kind of special Michael Jackson impersonator.

This case was objectively “worse” than Penny and he doesn’t get charged. Too funny.

This was definitely in immediate self-defense. Whether Penny acted in self defense is yet to be decided.

Because it's mainly white people who are targeted for defending themselves.


That young man is lucky to be black.. otherwise, life in prison would be a very real possibility for him.

I wish our justice system wasn't so biased. Neither of those young men should've been charged.

Not at all. As usual, you are confusing an evaluation of the applicable statute with the result that I would subjectively LIKE to see.

There was never any question in my mind that he was de facto engaged in the defense of others, and (as I said when he was arrested), "a prosecutor would have been quite justified in declining to file charges" against either him OR Penny. It was a case where "prosecutorial discretion," unburdened by political considerations, would probably have NOT given rise to the prosecutor seeking an indictment.

As the justification statute in NY is written, this gentleman had potential problems if the case went before a petit jury (absent jury nullification), due to the statutory definitions of "unlawful physical force" and "deadly physical force." My interpretation of the statute is unchanged

Fortunately, the grand jury declined to indict him, so he will not have to face a petit jury. Morally, I see this as the proper result in this case. Statutorily, I see some jury nullification from the grand jury here, but this is one of those cases where jury nullification seems justified. The prosecutor exercised his discretion and filed marginal charges, and the grand jury exercised the discretion to "no bill" the case.

Both of these young men should be thanked for what they did rather than arrested and 1 of them having to go to court to defend himself.
The young black male actually stabbed the attacker 5 times, I have no issue with what he did, and Penny held the attacker in a choke hold.
The young black male will not go to court and Penny the white male is going to court. It is amazing that they are carrying out this double standard right in front of our eyes and they know they will get away with it.
