If there is a "they" engaged in implementing a double standard," it is "the people of New York" as represented by the grand jury, right?
Of course, all of that assumes identical facts, and the facts of the cases are not identical. The assailant in THIS case actually assaulted someone (punched the girlfriend in the face), while the assailant in the Penny case was acting erratically and making threats but did not commit an assault (as I recall).
This gentleman was protecting a specific individual, whereas Penny subdued someone who was arguably not a "direct" threat to any individual, although his erratic behavior made him a "potential" threat to anyone on the train car.
Jordan's case (factually) for justification seems much stronger than Penny's case for both of these reasons.
Or the entire grand jury mechanism could be engaged in reverse discrimination against a blonde guy.

Penny is 100% a hero and should be walking free, but in fairness, based on the circumstances and actions of the deceased, the black kid getting charged was even more egregious than Penny being charged.

If you don't think a DA can influence a grand jury to come back with a conclusion of no finding, you are nuts.

The race baiter heads are exploding. Just days after this guy was arrested they were crying because his defense hadn't raised as much money as Penny's. So that was racist. So now the black guy is free and Penny is still fighting for his freedom. They won't be able to that crutch.

In one case there is evidence of an assailant assaulting a woman and being stabbed to death during a subsequent struggle with the man who then stabbed him.
In the other case, unless I’ve missed something, there is no evidence of Neely assaulting anyone before being killed or doing anything that warrants his killing.
The facts are vastly different in both cases. Making this about race in the way we’ve seen is racist.
