Yes!! This is how the law works. It is the totality of the situation that is examined which includes things such as the victims behavior, any intents he may have expressed giving insight into his thought process and its underlying impact on his behavior. Likewise, the same will be examined of the officers. It’s never as simple as he shot him, he’s dead, he is therefore guilty..

You have to overcome an officer believing he faced grave danger or bodily harm. If you want to pin first degree murder on him you have to prove beyond a reasonable doubt that the officer in question had ZERO reasonable fear for his safety or others.. and I’ll tell you from looking at the tape, his body language goes from a calm relative 5 to a 20 the moment the dead guy’s pistol is pulled. You can see him push the officer in grey out of the way and you can see him use his body to try and separate the agent on the ground from Pretti. Something triggered him to react and he moved with purpose. He didn’t casually pull his pistol, stroll around to Pretti’s rear and then open fire in cold blood.

Stupid decisions have consequences. DHS was doing their job, he was there to disrupt it. Whether he "deserved" what he got is not really relevant, whether the officer saw him as an imminent threat is. He objectively put himself in a threatening position by pushing back on a cop while holding a gun.

This isn't hard to understand. Responsible people that hold themselves accountable are holding this guy accountable for his actions as they influence the legality of the killing.

His death was the intended outcome of the protests. They blow whistles and foster chaos in order to create a situation which will lead to injury/death of “innocents” so the protesters can turn public opinion in their favor. This was an inevitable outcome by design and much more premeditated by the protestors than an accident committed by ICE, in my opinion.

If the officers are criminally charged, it’s unlikely the jury would ever see this video.
