Because defense allowed the shite/altered version in and didn’t challenge it aggressively. Jury already had it so judge let it (other version) ride hoping they won’t convict.

Judge absolutely should throw the case out. He won't. He has had numerous opportunities to toss matters (and the whole case) before it reached the jury and has punted to the jury every time. He wants the jury to do the jury's job, but he is supposed to be a gatekeeper and has not done his job. It's politically easy for him to wash his hands of it and put everything in the hands of the jury. But it's not how it's supposed to work.

At this point, my big question is whether he can issue a directed verdict or JNOV if the jury is hung. I would guess the answer is no. Even if the answer is yes I don't think he will have the stones to do it.

Are you saying 10-2 in favor of voting to acquit or convict?

Either way the result of a hung jury IS a mistrial so why do you say a mistrial would not be granted?

Also does anyone know if in Wisconsin a hung jury is even obligated to disclose the vote count on each charge? If the prosecution knows they lost the vote count by a margin of 10-2 on a charge, they would be idiots to retry those charges. But they have proven to be idiots so I guess they may do it anyway.

This isn't a civil liability case. The prosecution has made this case, knowing it has no basis in criminal law, to sway the public and gullible jurors.

It doesn't matter that he chose to be there. So did the rioters. It's irrelevant to these current charges.

Thank you. This is unbelievable that the defense didn't go after that very aggressively. So, they get to share some of the blame.

Yeah I have literally been watching the trial and objecting to obvious BS from the Prosecution aloud at the screen and the Defense just sat there and took it. I’m not a lawyer, worked in the industry for 15 years, but even I knew grounds to object on some of the Prosecution’s crap. Very disappointed in those two Defense attorneys.
