The GOPe and the rest of the #neverTrump crowd are going to try and distance themselves from Trump as fast as possible in the hopes of sapping his support

They'll be talking real big about 'fighting' the Left real soon but remember these moments as these moments tell us who they really are.. they're cowards

The 14th Amendment bars the President from running again if he's been engaged in insurrection or rebellion against the United States. It only requires a simple majority vote, as well.

They don't have to use the 14th Amendment. If they vote to convict, under Section 3 of Article 1 of the Constitution they can vote to disqualify him from holding public office in the future.

quote:

Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under the United States: but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.

Of course, this has never happened before for a President (it has for judges) so in theory there could be an argument that the President isn't an office of honor, trust or profit. Doubtful though.

So, is that what you think they are going for here? Do you believe that there is presentable evidence that Donald Trump has "been engaged in insurrection or rebellion against the United States"?

These were the kids in high school who hung out on the fringe of the popular crowd and were forever trying to become popular and never quite succeeding.

i actually read an article earlier today (NPR maybe) that said it took 2/3 to remove from office but majority to prohibit it

i looked at their citation and i didn't see it

It's never been tested in the courts and the constitution isn't clear on whether it takes 2/3 or simple majority. We've only had 3 individuals ever barred from holding public office again under these rules (all judges). Two of them were barred with a supermajority, one was a simple majority.

Not that I'm shocked China Mitch is pulling this, but if ANY so-called conservative casts a vote for a republican again - should they actually do this - you are the cuckiest of cucks and a hopeless fool.

Mark Halperin on Newsmax today reported: Mitch McConnell and establishment Republicans reportedly don’t want to see Trump on the ballot in 2024. McConnell’s latest move in the senate may be about not only to convict the president but to pass with the majority something that would bar him from holding office again.

If they want this guy to never to vote R again, that would be how to do it.

I think they're looking at the 14th Amendment or Article I, Section 3 that Mickey mentioned. I'll leave the rest to the Constitution experts, since I'm not qualified to answer your question.

I honestly hope they convict and vote to bar Trump from running again.

That way Trump can sue and SCOTUS will take it up.

We need definitive answers on whether or not Congress has the power to impeach and convict someone who is no longer in office and whether not they have the power to prevent someone from running for office again.

Settle this once and for all.

I mean...if they honestly thought they COULD be voted out, would the GOP even be attempting any of this? It's like a giant frick YOU to the GOP voter base knowing they can't do anything about it.

Well, when they hear a substantial amount of GOP voters saying "where else you going to go?" what do you expect. They are taking the easy path...

What's the constitutional mechanism to do that?

If the Senate votes to convict on impeachment they can take another vote to prevent him from ever holding office again, that is a simple majority vote.
