The GOPe and the rest of the #neverTrump crowd are going to try and distance themselves from Trump as fast as possible in the hopes of sapping his support

They don't have to use the 14th Amendment. If they vote to convict, under Section 3 of Article 1 of the Constitution they can vote to disqualify him from holding public office in the future.

It's never been tested in the courts and the constitution isn't clear on whether it takes 2/3 or simple majority. We've only had 3 individuals ever barred from holding public office again under these rules (all judges). Two of them were barred with a supermajority, one was a simple majority.

I think they're looking at the 14th Amendment or Article I, Section 3 that Mickey mentioned. I'll leave the rest to the Constitution experts, since I'm not qualified to answer your question.

I honestly hope they convict and vote to bar Trump from running again.
That way Trump can sue and SCOTUS will take it up.
We need definitive answers on whether or not Congress has the power to impeach and convict someone who is no longer in office and whether not they have the power to prevent someone from running for office again.
Settle this once and for all.
