The responanses in this thread blow my mind from both sides. The one thing all forget if you watched the testimony live or the transcripts, is he wrote the memo on a classified computer in the FBI vehicle when he left the dinner. That right there is grounds for prosecution being that made it a classified document when he done it and then released it to the press. There are a few instances in his testomony he really contridicts himself and you could say perjury or incompetent. Maybe the phrase nut job is bigger than most want to believe.

This conversation has already been had in the case of what POTUS shared at the meeting with the Russians just before the overseas trip. The meeting in the WH where the MSM was freaking out at being shut out while a Russian journalist was allowed.
The end result: POTUS is the ultimate authority on what is/not classified and when/if anything can be released.
Earlier in election cycle had the discussion regarding Hitlery's email server about when the designations occur. Result: at any time before, during, and even after release to authorized personnel, stuff can be deemed classified. That makes it really sticky as today it may be OK to share "doc A", but 2 weeks later, ooops, shoulda been marked as classified so now "doc A" is out there and anyone holding it is in violation of law.(meaning burn or shred NOW!)

Then why did he take memos on Trump? Clearly he felt something was wrong...he took memos of the meetings. Being an experienced lawyer of 30 years, can he not look at the facts and determine whether something is illegal or not!? He was the DIRECTOR of the FBI for God's sake!

Executive privilege is what you try to invoke in order to not have to do something, such as answer subpoenas or submit documents. It doesn't usually apply to people talking about you, and would be especially tough to get a judge to shut someone down after you've tweeted and granted interviews about the same subjects. As I read, it's a shield, not a sword.

Well, it happens when there are huge bureaucracies with multiple agendas.
Like for example some Russian Veterinarian having a bestiality vid of a US Senator while visiting Russia.
FBI gets word, writes it up, decides since out of country activity not their jurisdiction, not classified. Done. Memo off to storage.
At storage someone notifies CIA, who sees the vet is Boris Yeltsin's grandson so is connected to Russian govt, raises concerns doubly (not just damaging to Senator but now with Russian Govt. possibly involved open to blackmail/control). Changes designation to Special Access Program (SAP, or, the highest designation since could affect serious US Govt. activities).
ETA could be 2-3 weeks/months between the FBI (unclassified) and the CIA (SAP) so video could be posted to youtube in that time as unclassified. Pretty tough to put that genie back in the bottle.

Then why was everyone asking about whether Trump would stop Comey testimony by invoking executive privilege? I thought he still had it & could've used it in this case.
