Lack of evidence points to premeditation. To kill someone in today’s world and not leave evidence takes extreme planning and probably inside information. I wouldn’t be shocked if the police were involved.

My assumption is that he couldn't swim very well which is why he didn't get in the boat. Eventually he decided to try to swim back on his own a failed.
That's what logically makes sense to me. Ben Crump is going to find foul play no matter what happened though. He can't make money off of anything else.

It’s 5 miles of open water. There’s nothing logical about that.
But yes. He will claim that the result is inconclusive and he will not rest until all the facts have come out.

He was actually going out with his white friends that day because he planned to confront them about their fascism and white privilege, according to his handwritten journal he was preparing for a dissertation. Nobody knows how those white friends might've reacted, and nobody's blaming them, but questions need to be answered. Even superior swimmers can drown in rip currents, which are known to happen in that area. Doesn’t seem likely that he’d try to swim 10 miles back to shore.
The boat he decided not to get into had troubles with the bilge pump and had to be towed back to the mainland, which is probably why he decided to wait.
Who knows what else was involved. Probably alcohol, maybe a girl he was interested in who was still on the island ,etc.

I guarantee you it's going to be something that contradicts (or raises doubt about) the Jackson County Medical Examiner's autopsy.
