If I'm in a deer stand out of season with a rifle, but I don't shoot anything, was I actually poaching?

No. Of course not.

ETA: if you believe being in possession of a firearm makes someone guilty of poaching then most everyone here is fubared.

Not sure where you hunt but it’s always hog season in my neck of the woods.

I can hunt hogs day or night 365 days a year. I’ll sit in the stand during deer season and stay after sundown to shoot hogs. Should o get a ticket just because I have the ability to do something illegal but don’t?

Yep, as a land owner in MS, I can hunt for coyotes year around and I'm almost always in a deer stand doing it.

99% of my interactions have been great. We had an old ahole when I was a teenager that was an arse. Can’t really blame him though we were a rough bunch in those days. Two really good friends and high school buddies are now in my county. They’ll take my call whenever about whatever. Overall I’ve had pleasant experiences. I’m also not an outlaw.

Overzealous game wardens a/k/a the power of the badge. They should be terminated. There is no place for behavior such as this in law enforcement.

He was gonna shoot that deer until he glassed it long enough to determine it was a trap, then sped off.

Probably not. The guy has a night hunting permit. He hunts coyotes and films it for social media. He’s apparently decently known. Even the game wardens recognized him

They game wardens were over eager. Then they wanted to seize his new truck. Even saying it was a “career case” after they saw it and ran it and saw it was just purchased.

Haven’t heard that name in a while. He was behind every tree in NELA for a while. Lol

Alabama allows you to shoot hogs/coyotes at night beginning the day after deer season closes until deer season begins again in the fall.

That sounds like a real melt. Seems like the young fellow was just doing the job that he gets paid for. I would imagine that it was just as cold out there for him too but he was there because he had an obligation to fulfill while you were out there for fun.

Only question now is, how much does he accept/did they offer, as settlement in lieu of trial and did the woods cops lose their jobs?

That said, I rarely ever see them in Miss.

I grew up in a area that was small and had one main game warden. Dude was a pit bull and would ticket you for anything. I heard rumors of him measuring the size of orange vests to make sure they were big enough.

Dude was a POS. I never hand any interaction with him myself hunting or fishing but I met him at a game show and he was a douche.

One thing I've noticed over the last 2-3 decades is the change of culture in the game warden community. When I was a kid, game wardens were hunters and fishermen, also. They knew what was going on and what was really an offense vs honest mistakes. Now, it seems as if the community is flooded with young guys out of the police academy looking to pad their resumé so they can move on to better jobs. They aren't hunting and fishing enthusiasts. They look on everyone they encounter as suspects to make a case on instead of people enjoying the outdoors.

I’ve never had what I would consider a bad interaction with a GW in any state. But I will say this about Louisiana game wardens, out of the handful I know, all but one are complete jackasses and idiots. Looking to completely destroy someone so they can get a write up in their quarterly report book. Would love for some of their crooked asses get caught up in some BS like this OR get caught doing their own outlawing.

Might have been night hunting, probably was in my just my opinion. Girlfriend was the lookout using the mono and would have taken over driving had he shot and while he drags the deer to the road.

But a strong case ain’t built on might’s and maybe’s.

Same as always. Some people are dicks. Those dicks get jobs. Doesn't make their profession bad... it just means some dicks do every job that exist. There are more dicks than you realize.

Not sure how you could ascertain any of that from the video. Pretty sure all the gear was still in cases stowed away, they 100% would have brought it up as evidence if he had anything out or within arms reach.

Do y'all keep your rifle loaded in the truck? I don't.

Agree with folks that say he was looking around for deer at night, but he didn't do said thing and by the law he should not have been arrested. He did not spotlight. Game wardens were definitely over zealous.
