Would you get a lawyer (workplace injury)?

So my daughter(no pics) was injured at work in May of 2021. She was 16, first job at fast food, and some dumbass she worked with though he would splash her with water.

Except the water was the bun steam water. So she ended up with some severe 2nd degree burns on her legs.

Looking back we probably should have spoke to a lawyer then, but we didn't want to make a huge deal of it and just wanted the company to pay for her medical bill and medication/treatment, etc.

So of course they agreed to that and paid all the medication/treatment stuff and had us send them the emergency room bill.



Well fast forward to this year and our state tax return is taking forever to come in.

When it finally does its about 200 less than expected... due to money withheld for a unpaid medical bill.
They never paid it.

So we contact the Manager two weeks ago and he says he will contact corporate and get back with us. One week, no word. We contact him again, still no progress. Now another week has passed.

Now I'm to the point I want to lawyer up.

You may also want to check and see what the statute of limitation is in your state, you may be out of time if it is two years for liability.

An attorney can definitely answer that.

too late, statues of limitations is one year. Also, you want to lawyer up over 200 bucks? This has to be a troll... roll tide!

You may have a case, but the lawyer is going to cost way more than $200. Depending on the jurisdiction, as she wasn't seriously injured, lawyers may not want to take the case.

I’m fairly certain they’d need a Judgment against you to permit them to seize a portion of your tax return. Did you ignore collection letters, service of a lawsuit by the Sheriff? A default judgment served on you? You’d have to have notice of this in advance.

If you have a friend or relative that is an attorney, have them write a letter with their letterhead. It may be enough to scare them into doing something.

My wife's cousin is an attorney and he did this for us once for a contractor that owed us money and it worked.

She was legitimately injured at work, you should’ve lawyered up immediately after the incident. This is what happens when you don’t have experienced representation.

yep, this sounds suspicious, IRS don't give a shite if you have an outstanding ER bill, they ain't got no time fo' that, they're not bill collectors either, except for themself

Not yet. Stay on the company for another week. Ask for the contact of the person who can fix it for you.

I've never heard of someone not getting their state refund because they owe a medical bill???????
