I think there’s some stipulation in the law that the picture must be of a sexual nature. If it’s just a baby swimming it doesn’t equate to child porn. I’m not an expert though. Let me ask Acreboy.

Images/videos must be sexual in nature to be considered porn.

Same reason why it's okay for national geographic to show clips of nude underage children in Africa.
