WILKES COUNTY, N.C. (WBTV) - A moonshine still reportedly caused an explosion and fire in the North Carolina mountains this week.

Special agents from the state Alcohol Law Enforcement Division (ALE) were called in to investigate after the explosion on Monday, Oct. 26 in Wilkes County.

Once the special agents got to where the explosion happened, they found an active 200-gallon illegal distillery.

Agents reportedly seized about 1,800 gallons of mash -- which is used to make moonshine -- and 161 gallons of the illegal liquor.

Following the investigation, 69-year-old Billy Ray Anderson was arrested. He was charged with the offenses listed below:

Manufacturing a non-taxpaid alcoholic beverage
Possession for sale of a non-taxpaid alcoholic beverage
Possession of a non-taxpaid alcoholic beverage
Possession of distillery equipment
Possession of distillery ingredients
Allowing property to be used for the manufacture of a non-taxpaid alcoholic beverage
Pictures shared by state officials showed the inside of a metal building charred. Distilling equipment also appeared damaged.

It's a shame that this is illegal, while states are legalizing MJ.

there is some movement towards allowing home owners to distill their own hootch. Distilling ethanol in a kitchen is inherently dangerous . Home made assemblies will leak the highly flammable ethanol which will be ignited by the heating source used to run the still. First hand knowledge!

Prohibit based solely on explosion hazard.

this issue is before SCOTUS. A TX district court ruled the prohibition to home distilling unconstitutional, the 5th circuit agreed. The 6th circuit has a similar case and reach the opposite conclusion. On October 19, 2026 SCOTUS granted writs and now will hear oral arguments on:

quote:

Whether the prohibition on the production of distilled spirits in particular locations, including "in any dwelling house" or "in any shed, yard, or inclosure connected with any dwelling house," 26 U.S.C. 5178(a)(1)(B), is necessary and proper for carrying into execution Congress's enumerated power to lay and collect taxes

above quote comes from the docket sheet.

Serious question, what kind of a market is their for illegal moonshine? Who buys this stuff?

I can walk into any liquor store, or a Walmart, and buy a bottle of whiskey off the shelf for about $20. Why would I buy something illegal that could make me go blind?
