Update page 3 - Auto Insurance Question - Got hit in a parking lot

So coming home from family vacation (Gulf Shores) I stopped at a gas station to get my kid something to drink. I walk outside to find some baw in a mid 90s F250 backed out his his space too sharply and caught the bottom part of my vehicle. He was driving away until the wife created a scene which got him to pull back in.
Here's what I've got -
Guy had current State Farm policy - Under flooring company as holder
Guy driving didn't have his license on him
Passenger did and got a copy of his
Called the cops and they told me to kick rocks as its private property.
Now State Farm is saying they can't get in touch with the policy holder. It's been about a week since I opened the claim.
How screwed am I? Should I involve my insurance? My vehicle is brand new and its probably 2-4k in damage I'd assume. Any insight would be greatly appreciated.

You already involved insurance. Let your policy pay out and subrogate. It's what they do.
You will be fricked with a reported accident and increased rates either way.

I would file it on your insurance, let the companies fight it out. Did they file a police report of some sort?

There was no police report. They wouldn't come to the scene since it was private property. Said exchange info and have a nice day.

It's on State Farm. Jeep claim with them and persist. Google the local agent on the insurance cert you got and go thru them.
Know any local State farm guys? Ask them to help

get your company involved. they are arbiters of the law on your behalf and they are paid to do so.
i would reiterate that you do not wish to file a claim on your policy, but to get them involved because they have more resources than you do.
they will make state farm pay, you won't.

There will be a claim and claim # created whether you want one or not if your insurance is involved

I don't know how many times I have been asked this over the years by clients, family, friends, and randos at parties. The answer is if you have collision and comprehensive just call your insurance and let them do what you pay them for. That is exactly what I do.

Cops were wrong to tell you that. They cannot write the other guy a ticket, but they can write up an accident report. My son rear ended another car in a Hobby Lobby. Cop came and wrote an accident report but didn't give my son a ticket. Literally hardly any damage to the vehicles. Three month later, the guy my son hit was claiming injuries and was suing my insurance company for my maximum coverage plus a million from my umbrella policy. I told my insurance company to go to court and prove this idiot a liar. They wouldn't do it and gave the a-hole $20,000 in a settlement.
On another note, I was hit by another driver in my brand new truck. Her insurance tried to lowball me on diminished value so I ended up making a claim on my own insurance. Ended up getting $4000 more than what her insurance offered.

Yes. File claim directly with his insurance.
You’ll have to chase it but they will cover.

20 years working for state farm here.
IF the facts are as stated then yes it would fall on state farm. Problem is without proof, it's he said/she said. Without a statement from their insured state farm will not accept liability, unless there is evidence of some sort
I mean think about it, if somebody called to file a claim on your policy wouldn't you want your company to hold off on doing anything until they spoke with you?
I'll say this, in my experience when they get a letter from state farm saying he we've been trying to contact you regarding an accident that we have been told you were involved in, they usually contact their agent relatively quickly and then state farm can get their statement and proceed with accepting liability and paying out the claim.

The call to the police should have involved, "I think he's been drinking"

This doesn't make any sense. They didn't do an accident report because it was private property? That's just a shitty/lazy cop.
That may frick you unless there were multiple witnesses around who will be able to corroborate your testimony.

That's always what I do as well. It's always worked out.

Don't stop at a trashy gas station with a brand new car.

Insurance companies pull this bullshite all the time, and if you didn’t take pictures of grandpa's truck, then you could be screwed. Always take pictures of the other vehicles damage and license plate, and driver. I learned the hard way. I even filed as an uninsured motorist claim, but my insurance tracked down that the guy had insurance, so they wouldn’t pay, and that’s the last time I paid for uninsured motorist.
