Well, the state just said they're good with 2 to 20 to the jury.

It appears the state is now trying to play politics with the sentencing to placate the hoard outside. I'd be pretty pissed as a juror if you put me through this shite show only to be cool with giving him a slap on the wrist.. Remember these people live in this community, a rather affluent community which in all likelihood means they don't want this trash in their city

Judge John Roach was informed that the state agreed to the addition of "sudden passion" as the jury continues with the sentencing phase, meaning that the defense can argue that the murder was committed when the defendant was in an intense emotional state triggered by immediate provocation from the victim.

This will move it to murder as a second degree felony which can be sentenced 2 to 22 years.

The defense not having anything to prove self-defense and doing relatively little to hammer down self-defense and being in fear of losing his life helps them avoid contradicting themselves in front of the jury.

Even with the preponderance of the evidence requirement it should only work using the black definition of adequate cause and provocation, but it still seems like this is a possibility with jury viewing the actions of a teenager. Might depend on how hard the DA pushes back.

quote:

Sec. 19.02. MURDER. (a) In this section:
(1) "Adequate cause" means cause that would commonly produce a degree of anger, rage, resentment, or terror in a person of ordinary temper, sufficient to render the mind incapable of cool reflection.
(2) "Sudden passion" means passion directly caused by and arising out of provocation by the individual killed or another acting with the person killed which passion arises at the time of the offense and is not solely the result of former provocation.

quote:

(c) Except as provided by Subsection (d), an offense under this section is a felony of the first degree.
(d) At the punishment stage of a trial, the defendant may raise the issue as to whether he caused the death under the immediate influence of sudden passion arising from an adequate cause. If the defendant proves the issue in the affirmative by a preponderance of the evidence, the offense is a felony of the second degree.

I know this isn’t necessarily your own opinion, but I just don’t understand this mindset.

This kid couldn’t even make it to 18 without losing his cool and murdering one of his peers. How is he going to handle the stress and responsibilities of being an adult?

He’s proven he will not be able to. He should be removed from a functioning civil society.

I believe that black Americans historically and even today face a different reality than whites in our justice system but I also believe this wasn't the case this time.

Yeah you’re right they do. Blacks commit violent crimes in cities all across the country damn near every day and are let right back out on the streets to do more crimes. How many innocent lives have we seen ruined bc of “progressive” no bail laws?

Your arse need to wake tf up.

Today proved that, at least in Texas, you are not allowed to stab a kid in the heart for asking you move seats

Even if you are a black guy and the victim is white

THIS IS NOT FAIR AMERIKKKA!!!!

This to me is beyond wild that they would agree to anything that would shift responsibility onto the victim, especially when ZERO evidence was presented that shows the victim provoked his own demise. Asking someone to leave the tent is not an unreasonable request. For the DA to give any credence to the idea a reasonable request is provocative is fricking wild

That’s so ridiculous. Why would the state agree to only 2 to 20 years?

What a joke I knew they were going to try to slide their way out of this and he wouldn’t get much time

Was watching that live and there was a 6/7 year old girl next to those two on her phone filming.

We’re so fricked as a society.

If the jury agrees with the sudden passion argument, the charge is reduced to a second-degree felony, which lowers the punishment range to 2 to 20 years in prison.

Frick that. Is it passion to grip a knife and say touch me and see what happens to an unarmed person? The thug needs 99 years…

How am I supposed to know if you’re serious or not? Most people have no idea how govt works so it’s really not that far fetched for someone to say.

Also you’re not El Gaucho so……

I stated that the Metcalf kid should have gotten assistance from an adult because 17 y.o. boys aren't going to listen to other 17 y.o. boys.

This murderer wouldn’t have listened to a white adult either. He’s going to get what he deserves.

I feel like the prosecutor could've gone hard on the character witnesses against Karmelo to get as harsh a sentence as possible, but chose not to.

I'm sure there are plenty of witnesses that have seen him behave like a piece of shite before. This isn't his first time doing something. shite, the photos of him doing hoodrat shite and acting cool about it are online (and in this thread).
