On Wednesday, his lawyers succeeded in getting Collin County Judge John Roach removed from the case. Retired Kaufman County Judge Michael Chitty was assigned to handle the motion for a new trial.

The defense’s motion doesn’t argue that Anthony is innocent. Instead, it argues that his trial was conducted in a way that violated his constitutional rights.

It points to the trial being effectively closed to the public, claims prosecutors did not honor an off-the-record evidentiary agreement that ultimately forced Anthony not to testify and argues that jury instructions were made in a way that made it difficult for them to consider Anthony acted in self-defense.

It’s interesting that hundreds of adults have a weekday off from work to hang out around a courthouse to protest in FAVOR of a teen who brought a knife to a high school track meet & stabbed another unarmed teen in cold blood & then ran off. George Soros & other NGO’s doing work.

And then, at the same time, demand "justice for Nolan Wells" when there is zero evidence of foul play.

At some point this double standard and reverse racism has to be dealt with. There is a population (or now populations) in this country who is free to say anything derogatory they want with no repercussions when they cry foul and attack when the opposite happens.

Was his attorney not present at the time the jury was given these instructions? Was he not allowed to also speak to the jury, or object to the instructions being given?

Judge Chitty is as hardnosed as they come. He used to be a rather lenient judge. He was lenient one time to many and it resulted in several deaths of his friends and colleagues.

Basically, prosecution agreed not to bring up Anthony's past history of violence at school if the defense agreed not to impugn Metcalf's character since he was deceased. They both agreed that the past was not germane to the present crime and had no bearing on the outcome.

I’m sure this goes into the likely claims they have of ineffective counsel against his lawyer.

They could have afforded a better one if they hadn’t blown his defense money on extraneous shite instead of defending him.
