Make your argument fit the law:
943.1717 Use of dart-firing stun guns.—
(1) A decision by a law enforcement officer, correctional officer, or correctional probation officer to use a dart-firing stun gun must involve an arrest or a custodial situation during which the person who is the subject of the arrest or custody escalates resistance to the officer from passive physical resistance to active physical resistance and the person:

Specifically, explain what you think the teen did that equals "active physical resistance". I get paid to make these sorts of arguments and I am scratching my head about what I would suggest to a jury.

Noonan said the kid wasn't passive, and I agree. If a cop is acting on suspicious behavior (which is debated in the thread obviously) and trying to asses the situation, and the kid is noncompliant and moreso telling him to "frick off, I didn't do nothing," that is the kid escalating things.
Now, this was all mishandled by the cop as soon as the taser was pulled, and could've still been handled properly once that happened, but it wasn't. As I've stated several times in here, the cop should've verified from the home that the kid was supposed to be there, and that's that. Even if he kept the taser our for both of their safety, that should have happened. But it didn't, and the cop tased him anyway.

Look carefully, I never said you did.
We can discuss whether the Florida law is right or wrong but that is a distinct discussion from the actual situation here. I think it is very difficult for the officer to argue he met the requirements of his state's law to employ a Taser.

If the law states that the kid has to actively be physically resisting in order to get tasered then I guess the cop was wrong.
But as a parent, if this was my kid, he's getting grounded. And I think the law should be changed.
