Restaurants charging an administrative fee

At Tacos and Beer on Saturday in Hammond, America
Get the bill. Added to the bill is a 4% administrative fee.
There was a helpful explanation on the receipt: says it is charged to offset rising operational expenses and is applied to all transactions and all forms of payment including cash.
The issue I have is that this was not disclosed on the menu, in the restaurant, or by the server.
If you need to raise your prices, raise your prices. Adding an undisclosed gotcha at the last minute should be illegal.
I did ask the manager when I was leaving, she said the owners told them to do it.

This likely violates the new debit card laws. In order to charge fees on debit cards there needs to be a notice on the receipt or somewhere of a cash price and a card price. If they remove the statement about payment processing they would probably be ok though.

In Louisiana, that's illegal. Not saying it isn't done but like with debit card charges you should be able to notify the establish who has time to refund you the fees and if not, you can turn them over to the state AG where they can face fines.

Starting to see that as well. Also a “kitchen wellness fee.” These things get deducted from my tip.

Credit card transactions charge a 4% usage fee to the restaurant. Typically, that fee is included in menu pricing, it is interesting that the fee is included for cash transactions, generally you don't see that.

as much as you people bitch about restaurants- what they charge, how they charge, table service, table fare, clientele- I don't know why any of you miserable frickers even bother dining out.
just pack a sandwich and try to be happy.

Saw it yesterday on a restaurant tab in downtown BR. They referred to it as “inflation charge”

Just to be clear debit cards are allowed to tack on a processing fee to the customer. It has to be under dual pricing. Your receipt or something needs to have a cash price and a card price. A line item with a surcharge for cards is not allowed. It's always been heavily monitored and fined by MC and Visa.

I would not tip a single dime. I know it sucks for the servers but this would be the best way to attack it. They don't get tipped, they raise hell with the owner. He would lose his staff if he didn't revoke the fee.
This shite is unacceptable.

About 10 years ago, I remember a restaurant in Hammond charged extra fees for ordering to go food. I went to the bar and ordered 2 beers and a soup that I ate there. Separately ordered 3 items to go. (6 items total were ordered).
They charged me an extra $0.25 for each of the 6 items because I ordered to go food. Manager explained that it's to offset the cost of to go items. "It costs us extra to wrap the item up and put it in a bag with to-go utensils."
I told her that was ridiculous as eating in the restaurant costs labor to clean the plates along with soap/water used in dishwater. Along with the fact that a piece of paper wrapping up my po'boy's costs about half a penny. Finished with saying to remove the fees on the 2 beers and soup that I'm not taking to go. She said she would not do that. Of course I wasn't going to make a fuss about $1.50 past what I already said and paid it so I could get out of there.
Never ate there again. Restaurants that are scummy like this lose business and I don't understand the rationale to it. Like someone else mentioned, just add 5 cents to every menu item and no one would bat an eye. Makes no sense.

Dont eat out.
Why is there a restaurant every 100 feet in every podunk town in the whole country while everyone is simultaneously complaining about the cost of everything?

OP clearly said it was a fee applied regardless of payment method.
You’re applying the wrong law.

^ This right here.
Sorry, we are being fleeced, someone outside of the consumer needs to be squeezed to stop these practices. Enough waiters and waitresses will complain up when a lot of people start doing it and maybe the owners will stop screwing their customers.
American consumers are tapped...enough already.

Incorrect, not in Louisiana. if you accept debit cards, no additional processing, admin fee can be added. If you're adding a general admin fee to all purchases the price for debit should equal the cash price but that fee still needs to be posted in the establishment, easily seen prior to the point of purchase.

I take it out the tip and explain it to the server. Tell them to let their manager know that they are getting shorted on their tips because of their policy for hiding bullshite fees.

The 17 year old waiting tables isn’t making these decisions.
But that’s what I will do, followed by never returning

Next up will be the auto gratuities.
Ive started using more cash and debit but anywhere I see auto grat or blind admin fees being added, I don't return.

This, and I don't care that it isn't technically right. Not my problem.
