Question on HOAs and fines

So I am poor and live in a neighborhood with an HOA. I’m young and naive and didn’t realize how awful it is to have neighbors who think they can control every aspect. The worst part is my neighborhood doesn’t have any common areas except for two retention ponds and a sign in the front.

The issue we have run into is we recently were fined because the side of my house which doesn’t get sun had some mildew in the mornings. It is dried up by the afternoon. All the houses on my street have the same problem. Our house was the only one to get addressed by the HOA and fined. We got it cleaned up 2 days after we found out and had it pressure washed. I took before and after pictures. They claimed we didn’t have it done and could tell by the pictures. We submitted the receipt for the cleaning and they wouldn’t waive the fine.

The real kicker is we have not received any letters or notifications from the HOA and the only way we found out about the violation was the property management company e-mailed me. I asked them to send me a bill which never came. I also asked for a schedule of all the letters which were sent to our house. The property manager sent me a list of 17 letters over the past 18 months they said were sent. We never received a single letter and we had to appeal to the board.

The board voted last night to keep our fine but remove the late fees because we didn’t receive our mail. They also voted off the board member who supported us and argued on our behalf.

Is there anything I can do against the board or am I SOL?


Update: The one board member who was trying to help us out and talk to the property management company was just voted off the board for interfering.

Smear shite all over their houses and then report them for having shite all over their houses.

The thought has crossed my mind. The propert management company has a report a violation thing on their website and we were going to flood it with violations for the board members homes.

Unfortunately, HOAs are not truly democratic processes. They are in fact fascist dictatorships which rarely result in common sense and decency. My HOA enjoys putting liens on people's property and every time I see how much of the budget goes to suing each other, it pisses me off.

Bottomline for you if the appeal failed you are screwed. Move.

In my experience the people that run afoul of HOAs deserve it and are the reasons HOAs exist.

Ive lived in 2 neighborhoods with HOAs and have had 0 issues.

Maybe you are the exception idk

But seriously, you're probably screwed because you agreed to all that shite by moving into the hood, but youll have to sue them if you really want to escalate it. HOA's are good in theory and I understand why they exist, but it seems like more operate like this than actually help people.

The trick is to use weed killer the night before you leave town for a trip.

The giant cock in the front yard won't appear until you're long gone, so the fat freckled kid down the block will catch the blame.

Great idea but ours doesn’t work worth a shite. We still haven’t gotten approval to put in a dryer vent I installed over 2 months ago.

This is the correct answer, and god forbid if you don’t meet a quorum to vote on something. Whoever is on the board will make the executive decision with no oversight....

I get the concept of an HOA , but it always seems as if the people in charge go to extremely stupid authoritarian levels with it. I think HOAs have too much power , but then again you choose to live there knowing that there is an HOA.

For ours: They set a date and say the dues are due here. Liens are filed a month after it is late. That is one way. I have a real problem with that because I don't like what they do with the money and honestly there is no real way to change that. No real value to the HOA we have either. No pool or marketable intangibles. They even cut back on the police patrols in favor of the legal fees to be able to add liens. It's like the liens are viagra for the board, the more they can add the harder they get.
