You sir are correct.
Third party HOA admins such as Lewis Companies charge the HOA's a fee per house to manage the HOA.
All fines and dues collected by Lewis are deposited in a jointly owned (Lewis and HOA) bank account. Lewis is not allowed to outflow any money without permission from the HOA board.

The problem is, most don't exist in that capacity in practice. Most HOA’s are not out to get the residents within the community the bylaws are written for. Most complaints addressed are from neighbors complaining to the HOA about infractions. HOA is most cases is middleman, not the accuser or the defendant. All HOA’s must be clearly defined before transfer of property, so anyone not wanting to live in an HOA neighborhood with covenants, codes, and restrictions can easily do so. Anyone living in a gated community with private roads and common areas needs to have a well funded responsible HOA.
