Leins are very easy to file, just like mechanics liens and you can fight them at any point you like, most people don't and end up paying them at closing if they sell their house.
I am the chair of our HOA board and I don't lein houses unless they are in arrears AND the house is for sale. Most people catch up and we have a large surplus sitting for scheduled capital improvements so it does not impact our month to month.
One of the problems with the OP's HOA is that a property management company has been retained, they are often Nazis and you get one guy who wouldn't come to a neighbor like me or my board to complain but will pick up the phone and call the PM company in a heart beat. They love to fine since they are showing they are doing something besides paying the bills. In 12 years we have not levied a single fine and only filed 3 liens and while there are different factions a good board knows how to handle everyone and keep things civil.
ETA I should mention most PM companies have a vested interest in fines and liens, they get paid to file the liens and they get a percentage of revenue so they love them some fines. We explored is about 5 years ago but figured we had been fine for years so why pay people to make our lives and neighborhood worse.

I just got a letter for having my garbage can around the side of my house near the back gate. Literally the only way you would notice is if you drove through the neighborhood looking for garbage cans, which they do.
Our HOA sucks and is pretty useless. We have no pool, no lake, and hardly any landscaping. They hire a company twice a year to cut the vacant lots and that’s about it.

I learned very quickly that I would never live in an HOA ever again. I maintain a beautiful home but the petty shite they'd fine a homeowner for got annoying, really quickly. I understand the value of an HOA. To keep a neighborhood from losing value but when have nosey neighbors t hat will drive around finding issues....that's a problem for me.
I moved to an affluent neighborhood in Dallas that doesn't have an HOA and love the freedom to do wtf I want.

Most HOA bylaws will not stand up in court. I would call the management company and if all the houses are like yours and you were the only one picked out tell them you're getting a lawyer and suing for harassment.

remember, the squeaky wheel gets the grease. Show up to every meeting and raise hell until you find resolution. Get proof you were the only one fined for the issue.

I lived in one in Texas for six years. Every year, they had an annual meeting, one of the purposes of which was to elect officers. As a good community citizen, I would always go. Their bylaws required a quorum of 25% of homeowners present in order to conduct business, including elect officers. Their bylaws also stated that if quorum was not reached, then the current board would elect the new board.
In the 6 years... they never came close to having quorum, and every year, the old board would vote to just all re-elect themselves as the new board.
Complete joke.

People don’t like the look of trash cans being visible. If you don’t like getting a letter about hiding your trash cans then I have a simple solution....hide your trash can.
POAs are great if everyone does their part as intended. I’ve been on my POA Board for 3 years now. We don’t fine people but just leave notes on their door (hide trash can; remove trailer, mow grass). Of course we have people like you OP who blow up and think we are fascists; however most of the people in the neighborhood agree with the action.
If you live in a POA, YOU signed up for it when you moved in. Most Boards would welcome community involvement in changing the bylaws or covenants via quorum/meeting, but as someone else mentioned, it is hard to do thy when not even 10% of the neighborhood shows up. Also, lines are just an incentive to pay. Boards have to plan out the expenses for the year and need cash in bank, obviously, before bills can be paid.
If everyone does their part or can organize enough support to change the rules; POAs can work great.

I've never been in an HOA and never had the need for it. I'm not a prick who gets offended at small things, and usually have pretty cool neighbors as well.
The best part of HOA's is all the uptight people get to live in the same area and leave the rest of us alone.

You’re assuming they would; which if you live in neighborhood where half the people aren’t paying dues (to maintain pool, landscaping, clubhouse, etc) is a crap shoot. Also, I’m not leaving trash in my yard all weekend until they pick it up (Friday trashday).
Simple solution: hide the trashcans so that it can only hurt your property value and not everyone else’s. Agree to disagree.

I’m actually on the board of our HOA, but we are far from Nazi’s when it comes to things like this. We send out THREE warnings before a final demand letter. The board is notified of every demand letter sent and the date sent. Were you allowed to address the board in person at a homeowners hearing? That’s a bunch of BS and our board would never condone this.
