Well, naturally they probably have, but Disney wouldn't have paid if they thought there wasn't a case there. It's nice to see two parties settle a tragedy out of court.
On the flip side, it would be very hard for me to profit monetarily off of my child's death. I would probably ensure some sort of safeguard is put in place to lower the chance of it happening again and put the money into a scholarship fund or something. I'd feel dirty spending money that was made from my child's death.

I can tell you in my business, we carry professional liability insurance, and the insurance company will move heaven and earth to have a settlement before a lawsuit is filed. They absolutely pay on it. Saves them tons of money as the insurance generally has to pay the legal fees.

I don't understand the "problem" you think you are addressing here and what you think the "solution" for it should be. Do you not think economic incentives/disincentives apply to corporate activity because they are simply able to "pass it on"?

No doubt they've already been paid. Disney isn't stupid....they already had the check ready for the day something like this happened.
My guess is this kind of event is already accounted for somewhere in the financials.

The Disney Company has revenue of 56.42 BILLION from all sources in 2015. Parks accounted for 16 BILLION of that.
A 10 million settlement was probably paid out annually until the boy turns 18 or something. You are looking at less than a million a year, before the value of the tax deduction.
Just Magic Kingdom had 20 million attendees last year. They could raise prices 5 cents and be fine.
