Not quoted by the OP, is that the original police report said the homeowner opened the door and pointed a gun at the officer.

Funny how that didn't actually happen on the video though.

I think SC limits damages to $300,000. I'm guessing the homeowner will get the full amount.

This makes it even worse. If that officer did indeed write that in a report and it was later scrubbed from the official report, it shows an effort on the officer's part to cover up what really happened. Fortunately, the body cam video shows what really happened.

That cop is an idiot. He could have moved out of the “danger” zone quicker than shooting an unidentified target. It’s the only way to put it,he’s an idiot.

This is so bad.

Yes, the officer saw a pistol and i agree, i get being suspicious but this is so so bad.

There was no reason to start shooting through the window.

Ok, sure back off the porch, call for units and figure out what’s going on but don’t just go guns blazing.

One Saturday afternoon my GF and I were hanging around my house when there was a heavy knock at my door. It was a cop and started telling me there was a call of an alarm at my house. I said I didn't have alarm and before I could finish he starts yelling at me to show him my and GF's driver'a license. He still didn't believe me and wanted any bills with my name. It got real serious so I called the alarm company and they talked to the cop and told him they had made a mistake. I know it wasn't his fault but man did he act like an a-hole.

The 911 call only says "someone activated a silent panic alarm" not medical. Regardless of that, what the actual frick. The homeowner was spot on. "It is midnight, I am sleeping, and someone is at my door. 100% chance I go to my door with a gun too.

Yes, under SCTCA the limit is 300k per person BUT 600k per occurrence. That opens the county up to parallel claims from the wife for negligent infliction of emotional distress and loss of consortium.

The problem with him getting the full 300k for himself is if they want to play hardball the can low ball them since with all the time and expenses of a trial they are still stuck with the 300k max unless they were to be able to meet some pretty high standards. On top of that, you never know what the jury will do.

Outside of some pretty unusual damages on the wife's part she won't get near the other 300k.

In the end he wouldn't sign up to do it again for what they will get.
