The homeowner was spot on. "It is midnight, I am sleeping, and someone is at my door. 100% chance I go to my door with a gun too.
TIL entry doors with windows or sidelights are a bad idea.

I think the wife could probably get around $75-100k for her claim. Good case for the civil attorney

Wow. That homeowner is never going to have to work again.
The county just needs to ask his attorney how much they want and then write the check.

Dude should be charged with attempted murder.

Dude was a lot nicer about getting shot than I think I would have been.

Yeah we actually frosted our front door (we have four glass squares) and we always close the blinds. I could either check the camera, or use the eyehole. No chance I am putting myself in a sticky wicket.

It depends she may have no real mental distress and loss of consortium claims are tough to get juries to cough up on, well at least any significant amount.
Not knowing really anything about the damages I would think a total of the OT's favorite number $350k would settle it quickly given the limits in SC's Tort Claims Act.

I think he called the cop a motherfricker a couple of times.

Did the cop shoot him in the dick?

Dems da rules. At least they don't claim sovereign immunity in the negligence of their agents. Most everybody thinks limits on tort actions are a good thing until they aren't. It truly is a double-edged sword.

the original police report said the homeowner opened the door and pointed a gun at the officer.
Of course it did...

Which is still much nicer than what he deserved. This is exactly why I love that Indiana allows you to put them down in your own legal self defense.

At minimum, the cop should be fired and have some sort of weapons charge against him that will bar him from ever owning a firearm again.
He clearly cannot handle the responsibility involved with owning a gun.
Sucks the victim, who did everything right, can only get $300k. He deserves a lot more than that.

Some policemen shouldn’t be policemen.Unfortunately many police departments are having to lower their standards, have to take what they can get due to lack of applicants.

A cop seeing a person with a gun is like a hammer seeing a nail. No thought involved, just whamm!
