There is no working or people make mistakes with identity theft. Tell her to pay it now, or you file a police report. This has major implications and should be taken seriously.

My MIL is super helpful with the kids and a great grandmother. I already called her out on it and she was apologetic and said she would pay it off but I know she can’t. My wife wants no relationship with her right now but people make mistakes and I want to work with her and fix the problem. I don’t mind helping her pay it off for the sake of keeping a sane household, but am I an idiot for trying to keep my MIL and wife at peace?
Yes. No matter what happens, you will be the bad guy. She committed a felony, why the hell would you want your kids anywhere near her?

I would be extremely pissed if my mother in law did that. Seriously, I’d make her liquidate whatever asset she has that could pay it off immediately or get the police involved.

And you want to tell her it’s no big deal, pay it off for her, and then explain to you’re wife that she shouldn’t be mad?
Are you at minimum getting side action from your mother in law?

Mistakes are one thing, but opening a credit card in someone else's name is not a mistake. It was a deliberate act. What else is she doing that you don't know about yet?

This isn’t the first time she’s stolen from you. It’s just the first time she was caught. You need to take a long, hard look at how she interacts with your family.
As for trying to maintain peace, why? So she’ll continue to watch your kids? So your kids have a relationship with their grandmother? Examine why you think it’s important for someone that not only stole from you but could have resulted in serious financial penalties (interest in an unpaid credit card and poor credit score resulting in higher interest on any money loaned) is still intimately involved in your lives.

And can you afford to pay it off for her?

Freakin this. 5k of less would be one thing but 10-20k is outrageous. Plus, there’s a good chance you won’t have to pay it back if you involve the police.

Bingo. God knows what other debt she has out there and what she’s teaching or taking from your kids. Or worse, putting in their names.

Is your MIL worthy of MILF status?

So she stole the down payment on a home, vehicle, or your kids high school tuition.

Don't forget to add the future interest involved!

I don’t like the legal system and I don’t want to get the law involved. She’s selling her house right now and we’re talking about her paying back the credit card balance with the profit from the house.

What do you mean she can’t? If she’s got energy to spend money, she’s got energy to make money.
